The absence of VMS on-board most Thai vessels (as described in recitals 37) combined with weak collaboration with neighbouring states (Section 3.2 of this Decision) suggests that the risk of IUU activity occurring in the Thai fleet is high. This is supported by the extensive distribution of Thai vessels involved in IUU activities in the Indian and Western Pacific oceans in 2011 to 2014 (as stated in recital 26).

Stresses that the phenomenon of boat people, which affects Thailand and other countries, is essentially a regional one; views positively the efforts of the Thai Government to increase cooperation among regional neighbours to address concerns about the Rohingya people; welcomes, in this respect, the meeting held on 23 January 2009 by the Thai Permanent Secretary of Foreign Affairs, Virasakdi Futrakul, with the Ambassadors of India, Indonesia, Bangladesh, Malaysia and Burma; and appeals to the members of the Association of South East Asian Nations (ASEAN), and, in particular, its Thai chair and relevant international organisations, to work on a permanent solution to this long-standing problem;

Pursuant to the provisions of Commission Regulation (EC) No 298/2009 of 8 April 2009 amending Regulation (EC) No 474/2006 establishing the Community list of air carriers which are subject to an operating ban within the Community (4), the Thai DCA provided the Commission with information regarding the effectiveness of the corrective actions taken by the carrier Orient Thai, as well as measures taken by the Thai DCA to resolve the safety deficiencies detected previously, and which led to the suspension of the carrier’s operations with aircraft of type MD-80 for a period of 75 days until 7 October 2008.
