Particular focus will be on possibilities of: (1) simplifying and speeding up the registration procedure, taking into account the requirements of the electronic age; (2) increasing legal certainty, such as by redefining what may constitute a trade mark; (3) clarifying the scope of trade mark rights inter alia as regards goods in various situations throughout the EU customs territory; (4) providing a framework for increased cooperation between the Office for Harmonisation in the Internal Market (OHIM) at Alicante and national trade mark offices with the aim of harmonising administrative practice and developing common tools, such as those which offer far greater options for conducting priority searches, and watching the registry for infringing registrations; and (5) making the Directive more coherent with the Regulation, in particular, by further aligning the legal grounds of refusal for registration at European level, and (6) aligning the grounds for refusal and for coexistence under both the Directive and the Regulation to rules on geographical indications.

Even attempts to align the technical measures regulations in the Northeast Atlantic, Baltic and Mediterranean with the Treaty on the Functioning of the European Union (TFEU) have failed because negotiations have tended to move away from alignment to the detailed substance of these regulations.

This Regulation does not go beyond what is necessary in order to achieve that objective, in accordance with Article 5(4) of the Treaty on European Union.

This RPS package constitutes another significant step towards a comprehensive alignment of EU legislation to the new regime of delegated and implemented acts, as required by the Lisbon Treaty since almost four years. This alignment exercise was overdue.
