Considers that, especially at the stage of the drafting of Union legislation in the field of, in particular, civil and family law, room should be created for national and Union judges to have a say on the purely technical aspects of proposed measures in order to ensure that the future legislation may be implemented and applied with a minimum of difficulty by national judges; takes the view that this could also assist in creating further contacts between judges, thus opening up new channels of communication; positively welcomes input from national judiciaries in the course of legislative procedures;
14. considère que, spécialement au stade de l'élaboration de la législation européenne dans les domaines, notamment, du droit civil et du droit de la famille, les juges nationaux et ceux de l'Union européenne devraient avoir un droit de regard sur les aspects purement techniques des mesures envisagées afin de garantir que la future législation puisse être appliquée avec le moins de difficulté possible par les juges nationaux; estime que cela pourrait également contribuer à l'établissement de nouveaux contacts entre les juges, créant ainsi de nouveaux canaux de communication; accueille favorablement la contribution des juges nationaux aux procédures législatives;

Where immunity has been waived and criminal proceedings are instituted against a Judge, he shall be tried, in any of the Member States, only by the court competent to judge the members of the highest national judiciary.
