IN-CONTEXT TRANSLATIONS

The amendments to the COTIF Convention aim to improve and facilitate the procedure for revising the COTIF Convention with a view to the consistent and rapid implementation of amendments to the COTIF Convention and the Appendices thereto, and in order to prevent adverse effects of the current lengthy revision procedure, including the risk of internal misalignment between amendments adopted by the Revision Committee and those adopted by the General Assembly of the OTIF, as well as external misalignment, in particular with Union law.

The 1988 Lugano Convention was revised by the Convention on Jurisdiction and the Recognition and Enforcement of Judgments in Civil and Commercial Matters , signed at Lugano on 30 October 2007 by the Community, Denmark, Iceland, Norway and Switzerland (‘the 2007 Lugano Convention’).

Article 96 foresees that in cases of violation of one of those essential elements one party can invite the other party to hold consultations (a similar procedure had been introduced for the first time in 1995, through article 366a of the revised Lome IV Convention).

It started with the Yaoundé I agreement in 1963, widening to 46 countries under the Lomé I Convention of 1975, and totals 71 countries under the present Lomé IV Convention of 1995.
