Parliament shall decide on the act requiring its consent under the Treaty on European Union or the Treaty on the Functioning of the European Union by means of a single vote on consent, irrespective of whether the recommendation from the committee responsible is to approve or reject the act, and no amendments may be tabled. The majority required for the adoption of the consent shall be the majority indicated in the article of the Treaty on European Union or the Treaty on the Functioning of the European Union that constitutes the legal basis for the proposed act or, where no majority is indicated therein, the majority of the votes cast.

It should furthermore be noted that under Article 355(6) TFEU, the European Council may amend the status of an overseas country or territory as regards the application of the Treaties to that overseas country or territory, but the actual wording of the Treaties may only be amended by using the procedures in Article 48 TEU. The appropriateness of the European Council adopting decisions amending the wording of the Treaties can therefore be questioned, in particular taking into account Article 13(2) TFEU whereby each institution is to act within the limits of the powers conferred upon it by the Treaty.

Moreover, the bill required that the federal government respect the provinces' jurisdictions, including Quebec's. The bill provided for five important changes: all treaties were to be put before the House of Commons, the House was to approve important treaties, a parliamentary committee was to consult civil society before Parliament voted on important treaties, treaties were to be published in the Canada Gazette and on the Department of Foreign Affairs website and the government was to consult with the provinces before negotiating a treaty in an area of provincial jurisdiction.

On 18 November 2009, Parliament, Council and the Commission therefore agreed to continue the budgetary procedure under the EC Treaty, but also reached an agreement covering the outcome of the budgetary procedure, including Parliament’s vote, which took place in full respect of the Multiannual Financial Framework. The President of the Council has just confirmed the agreement of the Council on the budget we have just voted. This means that Parliament and Council have now reached an agreement on a joint text, respecting the aim and purpose of Article 314. I thus note that the budgetary procedure, that was initiated under Article 272 of the Treaty establishing the European Community and continued under Article 314 of the Treaty on the Functioning of the European Union, has been completed in accordance with Article 314 of the Treaty on the Functioning of the European Union and the Multiannual Financial Framework. The budgetary procedure can thus be deemed to be completed and the budget is declared definitively adopted’.

Then there is the problem of the situation regarding the Lisbon Treaty. If we do not have the Lisbon Treaty, a number of Member States including mine – to take off my Union president’s hat – have said that in effect the current treaty was a treaty of 27 and that in order to enlarge we did indeed need the Lisbon Treaty. I am telling you honestly, Mrs Doyle, that is the Council’s position at present.

The bill included five changes: the systematic tabling of treaties before the House of Commons, seeking the approval of the House for important treaties, consultation of civil society by a parliamentary committee before Parliament makes a decision on an important treaty, the publication of treaties in the Canada Gazette and on the Internet site of the Department of Foreign Affairs and, finally, the compulsory consultation of the provinces before any treaty on matters within provincial jurisdiction can be negotiated.
