In the case of an administrative authority, there is no requirement to guarantee the coherence of the Community judicial system such as that which, by contrast, justifies the power to suspend measures being recognised as vested in national courts, which are independent and impartial third parties (something which cannot, however, be said of an administrative authority).
En effet, s’agissant d’une autorité administrative, il n’y a pas l’exigence d’assurer la cohérence du système juridictionnel communautaire qui justifie au contraire la reconnaissance de pouvoirs de protection provisoire à l’autorité juridictionnelle nationale, organe tiers, indépendant et impartial (l’autorité administrative ne pouvant au contraire pas être considérée comme telle).
