[5] The three pillars previously forming the basic structure of the EU under the Treaty on European Union were the Community pillar, corresponding to the three Communities: the European Community, the European Atomic Energy Community (Euratom) and the former European Coal and Steel Community (ECSC) (first pillar); the pillar devoted to the common foreign and security policy, under Title V TEU (second pillar) and the pillar devoted to police and judicial cooperation in criminal matters, under Title VI TEU (third pillar).

(11) In accordance with Articles 1 and 2 of the Protocol on the position of Denmark annexed to the Treaty on European Union and to the Treaty establishing the European Community, Denmark is not taking part in the adoption of this Decision and is not bound by it or subject to its application. Given that this Decision builds upon the Schengen acquis under the provisions of Title IV of Part Three of the Treaty establishing the European Community, Denmark has, in accordance with Article 5 of the said Protocol, to decide within a period of six months after the date of adoption of this Decision whether it will implement it in its national law.

However, even if these reforms are implemented, the Council remains an absurdity, a remnant from the early days of the three European Communities, which is backing out of national parliaments and the EP.

4. Notwithstanding the provisions of paragraph 3, the Contracting Parties have agreed on the following arrangements: if, after five years and up to 12 years after the entry into force of the Agreement, the number of new residence permits of either of the categories referred to in paragraph 1 issued to employed and self-employed persons of the European Community in a given year exceeds the average for the three preceding years by more than 10 %, Switzerland may, for the following year, unilaterally limit the number of new residence permits of that category for employed and self-employed persons of the European Community to the average of the three preceding years plus 5 %.
4. Nonobstant les dispositions du paragraphe 3, les modalités suivantes sont convenues entre les parties contractantes: Si après cinq ans et jusqu'à 12 années après l'entrée en vigueur de l'accord, pour une année donnée, le nombre de nouveaux titres de séjour d'une des catégories visées au paragraphe 1 délivrés à des travailleurs salariés et indépendants de la Communauté européenne est supérieur à la moyenne des trois années précédentes de plus de 10 %, la Suisse peut, unilatéralement, pour l'année suivante, limiter le nombre de nouveaux titres de séjour de cette catégorie pour des travailleurs salariés et indépendants de la Communauté européenne à la moyenne des trois années précédentes plus 5 %.

7.1. Registered horses intended for permanent imports into the European Community must have been resident in the free area for three months or since birth if they are less than three months old or since entry if they were imported directly from the European Community during the previous three months.
