The Commission considers that the need to harmonise reception conditions is tied up with two main objectives: offering asylum-seekers an equivalent level of living conditions throughout the Community (irrespective of the Member State where they are) and avoiding secondary movements based on a difference in the conditions in different Member States.

(17) Since the objective of the proposed action, namely better foreseeability of court judgments requiring genuinely uniform rules on the law applicable to contractual obligations determined by a mandatory and directly applicable Community legal instrument, cannot be adequately attained by the Member States, who cannot lay down uniform Community rules, and can therefore, by reason of its effects throughout the Community, be better achieved at Community level, the Community can take measures, in accordance with the subsidiarity principle set out in Article 5 of the Treaty. In accordance with the proportionality principle set out in that Article, a Regulation, which increases certainty in the law without requiring harmonisation of the substantive rules of domestic law, does not go beyond what is necessary to attain that objective.
(17) Etant donné que l'objectif de l'action envisagée, à savoir l’adoption de règles uniformes sur la loi applicable aux obligations contractuelles afin d’assurer une meilleure prévisibilité des décisions de justice en la matière , ne peut pas être réalisé de manière suffisante par les Etats membres et peut donc en raison des effets de l’action mieux être réalisé au niveau communautaire, la Communauté peut prendre des mesures, conformément au principe de subsidiarité consacré à l'article 5 du traité. Exclusive jurisdiction for a certain category of actions and applications relating to a Community patent, and in particular for actions relating to infringement and validity, should therefore be given to the Community intellectual property court.

(30) Examination of supplies to port refineries throughout the Community, suggests that special priority access should be given to raw cane sugar originating in the ACP States party to Protocol No 3 and India, under special agreements negotiated between the Community and the countries referred to in Protocol No 3 and/or other countries and based on an estimate of the Community's requirements once all available raw cane and beet sugar in the Community, preferential raw sugar and raw sugar originating in countries benefiting from tariff quotas under trade concessions granted by the Community have been refined.
(30) L'examen de l'approvisionnement de l'ensemble des raffineries portuaires de la Communauté conduit à prévoir la possibilité d'un accès prioritaire particulier à l'importation des sucres bruts de canne originaires des pays ACP parties au protocole n° 3 et de l'Inde, dans le cadre d'accords spéciaux passés entre la Communauté et les pays visés au protocole n° 3 et/ou d'autres pays et sur la base d'un bilan communautaire après utilisation pour le raffinage des disponibilités en sucres bruts de canne et de betterave existant dans la Communauté, des sucres bruts préférentiels et des sucres bruts originaires des pays bénéficiant de contingents tarifaires couverts par des concessions commerciales consenties par la Communauté.

(3) In order to ensure that access rights to railway infrastructure are applied throughout the Community on a uniform and non-discriminatory basis, Council Directive 95/18/EC(6) introduced a licence for railway undertakings providing the services referred to in Article 10 of Directive 91/440/EEC, this licence being obligatory for the operation of such services and valid throughout the Community.

Council Regulation (EC) No 1992/2003 of 27 October 2003 amending Regulation (EC) No 40/94 on the Community trade mark to give effect to the accession of the European Community to the Protocol relating to the Madrid Agreement concerning the international registration of marks adopted at Madrid on 27 June 1989 [Official Journal L 296 of 14.11.2003].
