11. Every person who imports, makes, has in his possession or keeps any still, worm, mash-tub, fermenting-tun, distilling, rectifying or brewing apparatus, tobacco press or mill for cutting or grinding tobacco shall, forthwith, after the apparatus or machinery comes into his possession and in each subsequent year on or before April 10, give to the collector of the division in which the apparatus or machinery is located a full and particular list, description and return thereof, the same in nature and form as is required by this Act in an application for a licence to use similar apparatus or machinery.
11. The first concerns the prohibition on advertising in the press, with regard to which the general statement deriving from the decisions of the Court of Justice on the advertising of tobacco products to the effect that a ban on advertising can be contemplated, in principle, on the basis of Article 95, should probably be understood according to the very narrow Court interpretation of the Community’s competences in the area of the internal market and not as a kind of carte blanche for the issue of a general ban on the advertising of tobacco products in the press. This is as the current legislation stands.

The proposal for a directive seeks to approximate national provisions relating to the advertising of tobacco products and their promotion (a) in the press and other printed publications; (b) in radio broadcasting; (c) in information society services; and (d) through tobacco related sponsorship, including the free distribution of tobacco products so as to ensure the free movement of the media concerned and related services and to eliminate obstacles to the operation of the internal market (Article 1).

In principle, therefore, a directive prohibiting the advertising of tobacco products in periodicals, magazines and newspapers could be adopted on the basis of Article 100a of the Treaty with a view to ensuring the free movement of press products, on the lines of Directive 89/552, Article 13 of which prohibits television advertising of tobacco products in order to promote the free broadcasting of television programmes".
