In that regard, the Civil Service Tribunal took the view that while the examiners marking the written tests, in contrast to the members of the selection board sitting in the oral phase, may admittedly not be known to the persons concerned, and are thereby protected from interference and pressures to which the judgment in Parliament v Innamorati, paragraph 16 above, refers, that circumstance does not objectively justify the existence of significant differences between the requirements concerning the statement of reasons in the case of failure in the written phase, as those requirements are formulated in the case-law cited in paragraph 39 of the judgment under appeal, and those advocated by the Commission in the case of failure in the oral test, which, in particular in the instant case, would consist in giving the applicant only his eliminatory individual mark.

Paragraph 37 of the contested judgment makes it clear that the Court of First Instance considered the appellant’s arguments based on the aesthetic qualities and the design of the torches in question, but that the result of its analysis was that it took the view that those characteristics were not sufficient to confer on the marks in question distinctive character within the meaning of Article 7(1)(b) of Regulation No 40/94.

(16) Taking the same approach, the European Parliament, in its Resolution of 18 November 1999, recognised the European audiovisual sector's special role in sustaining cultural pluralism, a healthy economy and freedom of expression, reaffirmed its commitment to the freedom of action in the sphere of audiovisual policy obtained at the Uruguay Round, and took the view that the General Agreement on Trade in Services (GATS) rules on cultural services, in particular in the audiovisual sector, should not jeopardise the cultural diversity and autonomy of the WTO contracting parties.
(16) Soutenant la même approche, et conscient du rôle particulier du secteur audiovisuel européen dans la défense du pluralisme culturel, d'une économie saine et de la liberté d'expression, le Parlement européen a, dans sa résolution du 18 novembre 1999, réaffirmé son engagement en faveur de la liberté d'action dans le domaine de la politique audiovisuelle convenue lors du cycle de l'Uruguay, et estimé que les règles de l'accord général sur le commerce dans les services (AGCS) concernant les services culturels, notamment dans le secteur de l'audiovisuel, ne sauraient pas davantage à l'avenir remettre en question la diversité et l'autonomie culturelle des parties contractantes de l'OMC.

Whereas the European Parliament, in its resolution of 6 May 1994 (4), examined the problems of the audiovisual industry, following Council Directive 89/552/EEC of 3 October 1989 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the pursuit of television broadcasting activities (5) (the 'television without frontiers' Directive), in preparation for the European audiovisual conference, 'and took the view that the priorities established inter alia during the discussions on amendments to the Media programme, namely the financing mechanisms, pre-production, distribution and training, were the best means of establishing coherent, stable European networks';
