Recalls its resolution of May 2010 on recent developments in public procurement, which took note of the ECJ case-law and took the view that public-public cooperation was not subject to public procurement rules as long as the following criteria were met: that the purpose of the partnership was the provision of a public-service task conferred on all the public authorities concerned; that the task was carried out solely by the public authorities concerned, i.e. without the involvement of private capital; and the activity involved was essentially performed on behalf of the public authorities concerned; underlines the fact that transferring tasks between public sector organisations is a matter for the Member States' internal administrative organisation and is not subject to procurement rules; takes the view that these clarifications should be codified in the procurement directives;

It is one of the reasons why we took these services out of the Services Directive, because we did not consider that they operated to the same market rules as travel agencies, construction companies or anything else in the general services sector.

– (DA) Mr President, what would happen if a small Danish limited company with 100 employees were to draw up annual accounts about which a chartered accountant made a declaration emphasising that most of the reservations were due to the fact that they recurred from year to year; and if it were confirmed that the weaknesses were to a large extent due to the failure of the company’s accounting system to provide adequate assurance that its balance sheet was complete and included all the elements of the company’s activities; and if, in addition, the declaration stated that there were problems with the monitoring and security systems, and that the data in the system were not complete; and it continued by saying that it was a matter of concern that the company did not give a high enough priority to remedying these defects, and that it had not given sufficient consideration to the area or allocated enough resources to finding a solution to the problems within a reasonable time frame? What would happen if it was ultimately concluded that no declaration could be made as to whether the construction work, purchases or services forming the basis of the payments to the local recipients, actually took place? If all this happened, the board of directors would, firstly, refuse to give discharge to the management.

To ensure that these benefits took full effect, in conformity with the EC rules on competition, the services of the Commission had informed the participants that approval of the project would have to be subject to guarantees designed to prevent undue restriction of competition in the telecommunications services markets, such as discrimination against private services suppliers and cross-subsidization.

THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty establishing the European Community, Having regard to the Green Paper on the development of the single market for postal services, published on 11 June 1992; Having regard to the communication from the Commission on guidelines for the development of Community postal services; Whereas the development of postal services is an important feature of the development of the single market for the promotion of the economic and social development of the Community and its Member States; Whereas the provisions of the Treaty on the freedom to provide services cover the postal sector; Whereas the Green Paper and the abovementioned communication identify the aspects of postal services which are of Community interest; Whereas in view of these aspects it appears that efforts should be made at Community level to improve the efficiency and quality of postal services; Whereas the Commission has undertaken broad public consultation and has received contributions from interested parties in the postal sector; Whereas it is necessary to fix the main objectives of the development of postal services in the Community, in accordance with the Treaty; 1. GIVES ITS SUPPORT: to the general approach contained in the Commission's Green Paper on the development of the single market for postal services; 2. FREE MOVEMENT OF PERSONS Following the discussion which took place at the Internal Market Council on 28 May and the request made on that occasion, in particular by the French delegation, the Council discussed a number of aspects raised by the three Commission proposals for Directives of 24 August 1995 on respectively: - the abolition of checks on persons at internal frontiers; - the amendment of secondary legislation as regards the free movement of workers and members of their families and as regards the freedom to provide services and the right of establishment; - the right of third-country nationals to travel freely within the Community; In this connection the Council took note of statements from several delegations pointing out in particular that, over and above the objective of achieving the free movement of persons within the Community, these proposals related to important questions of immigration and internal security.
LIBRE CIRCULATION DES PERSONNES Suite à la discussion lors du Conseil Marché intérieur du 28 mai, et à la demande exprimée alors notamment par la délégation française, le Conseil a évoqué certains aspects soulevés par les trois propositions de directive de la Commission du 24 août 1995 visant respectivement - la suppression des contrôles sur les personnes aux frontières intérieures, - la modification du droit dérivé relative à la libre circulation des travailleurs et de leur famille ainsi qu'à la libre prestation des services et le droit d'établissement, - le droit des ressortissants des pays tiers de voyager librement à l'intérieur de la Communauté. A ce sujet, le Conseil a pris note des déclarations de plusieurs délégations qui ont relevé notamment qu'au-delà de la poursuite de l'objectif de réaliser la libre circulation des personnes à l'intérieur de la Communauté, ces propositions touchent à des questions importantes de l'immigration et de sécurité interne.
