ESMA shall regularly monitor the activity in derivatives which have not been declared subject to the trading obligation as described in paragraph 1 in order to identify cases where a particular class of contracts may pose systemic risk and to prevent regulatory arbitrage between derivative transactions subject to the trading obligation and derivative transactions which are not subject to the trading obligation.

Member States shall require that for financial instruments subject to the trading obligation in Articles 23 and 28 Regulation (EU) No 600/2014 each trading venue and systematic internaliser and for other financial instruments each execution venue makes available to the public, without any charges, data relating to the quality of execution of transactions on that venue on at least an annual basis and that following execution of a transaction on behalf of a client the investment firm shall inform the client where the order was executed.

Les États membres exigent que, pour les instruments financiers soumis à l’obligation de négociation visée aux articles 23 et 28 du règlement (UE) no 600/2014, chaque plate-forme de négociation et internalisateur systématique, et, pour les autres instruments financiers, chaque ►C3 lieu d'exécution ◄ mette à la disposition du public, sans frais, les données relatives à la qualité d’exécution des transactions sur cette plate-forme au moins une fois par an et qu’à la suite de l’exécution d’une transaction au nom d’un client, l’entreprise d’investissement précise au client où l’ordre a été exécuté.
