The legal basis to be used for the establishment of a Community patent jurisdiction was introduced into the EC Treaty by Article 2 (26 ff.) of the Treaty of Nice amending the Treaty on European Union, the Treaties establishing the European Communities and certain related acts which entered into force on 1 February 2003, inserting Article 229a and Article 225a into the EC Treaty.
La base juridique sur laquelle fonder la création d'une juridiction spécialisée dans le domaine du brevet communautaire a été introduite dans le traité CE par l'article 2 (points 26) et suivants) du traité de Nice modifiant le traité sur l'Union européenne, les traités instituant les Communautés européennes et certains actes connexes, qui est entré en vigueur le 1er février 2003 et a inséré les articles 225 A et 229 A dans le traité CE.

On 18 November 2009, Parliament, Council and the Commission therefore agreed to continue the budgetary procedure under the EC Treaty, but also reached an agreement covering the outcome of the budgetary procedure, including Parliament’s vote, which took place in full respect of the Multiannual Financial Framework. The President of the Council has just confirmed the agreement of the Council on the budget we have just voted. This means that Parliament and Council have now reached an agreement on a joint text, respecting the aim and purpose of Article 314. I thus note that the budgetary procedure, that was initiated under Article 272 of the Treaty establishing the European Community and continued under Article 314 of the Treaty on the Functioning of the European Union, has been completed in accordance with Article 314 of the Treaty on the Functioning of the European Union and the Multiannual Financial Framework. The budgetary procedure can thus be deemed to be completed and the budget is declared definitively adopted’.
Il en ressort que le Parlement et le Conseil sont arrivés à un accord sur un texte commun, conformément à l’objectif de l’article 314 du traité sur le fonctionnement de l’Union européenne. Je constate donc que la procédure budgétaire, ouverte conformément à l’article 272 du traité CE et poursuivie conformément à l’article 314 du traité sur le fonctionnement de l’Union européenne, a été achevée conformément à l’article 314 du traité sur le fonctionnement de l’Union européenne et au cadre financier pluriannuel. De ce fait, la procédure budgétaire peut être considérée comme achevée, et le budget est déclaré définitivement adopté».

(11) In accordance with Articles 1 and 2 of the Protocol on the position of Denmark annexed to the Treaty on European Union and to the Treaty establishing the European Community, Denmark is not taking part in the adoption of this Decision and is not bound by it or subject to its application. Given that this Decision builds upon the Schengen acquis under the provisions of Title IV of Part Three of the Treaty establishing the European Community, Denmark has, in accordance with Article 5 of the said Protocol, to decide within a period of six months after the date of adoption of this Decision whether it will implement it in its national law.

Article 300 of the Treaty establishing the European Community specifies four instances in which the conclusion of an international agreement requires assent on the part of the European Parliament. The first is where the agreement is an association agreement within the meaning of Article 310 of the Treaty establishing the European Community; the second, agreements establishing a specific institutional framework by organising cooperation procedures; the third, agreements having important budgetary implications for the Community, and the fourth, agreements entailing amendment of an act adopted under the procedure referred to in Articles 251 or 252 of the Treaty establishing the European Community.
L’article 300 du traité instituant la Communauté européenne prévoit quatre cas de figure dans lesquels la conclusion d’un accord international requiert l’avis conforme du Parlement européen: le premier, dans le cas d’un accord d’association au sens de l’article 310 du traité instituant la Communauté européenne; le deuxième, dans le cas d’accords établissant un cadre institutionnel spécifique en organisant des procédures de coopération; le troisième, s’il s’agit d’accords ayant des répercussions budgétaires importantes pour la Communauté; et le quatrième, dans le cas d’accords impliquant la modification d’un acte adopté au titre de la procédure mentionnée à l’article 251 ou 252 du traité en question.

Due to its being based on Article 175(1) of the Treaty establishing the European Communities, this proposal does not apply to illegal activities involving radioactive materials, but the Commission does not rule out consideration of when it might be appropriate to make a proposal on the basis of the Treaty establishing the Atomic Energy Community (Euratom treaty).
