3. The provisions of this Directive concerning comparative advertising shall not oblige Member States which, in compliance with the provisions of the Treaty, maintain or introduce advertising bans regarding certain goods or services, whether imposed directly or by a body or organisation responsible, under the law of the Member States, for regulating the exercise of a commercial, industrial, craft or professional activity, to permit comparative advertising regarding those goods or services.
3. Les dispositions de la présente directive concernant la publicité comparative n'obligent pas les États membres qui, dans le respect des dispositions du traité, maintiennent ou introduisent des interdictions de publicité pour certains biens ou services, qu'elles soient imposées directement ou par un organisme ou une organisation qui est responsable, en vertu des législations des États membres, de réglementer l'exercice d'une activité commerciale, industrielle, artisanale ou libérale, à permettre la publicité comparative pour ces biens ou services.

This Regulation shall lay down the rules to be applied as regards the applicability of Articles 81 to 86 and certain provisions of Article 88 of the Treaty in relation to production of, or trade in, the products listed in Annex I to the Treaty with the exception of the products covered by Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation)
Le présent règlement établit les règles relatives à l’applicabilité des articles 81 à 86 et de certaines dispositions de l’article 88 du traité en ce qui concerne la production ou le commerce des produits énumérés à l’annexe I du traité, à l’exception des produits entrant dans le champ d’application du règlement (CE) no 1234/2007 du Conseil du 22 octobre 2007 portant organisation commune des marchés dans le secteur agricole et dispositions spécifiques en ce qui concerne certains produits de ce secteur (règlement “OCM unique”)

In this case, State aid in the form of public service compensation granted to certain undertakings entrusted with the operation of services of general economic interest (see paragraphs 25-29 above) could be regarded as compatible with the common market and exempt from the requirement of notification laid down in Article 88(3) of the Treaty if the requirements set out in the Commission Decision of 28 November 2005‘on the application of Article 86(2) of the EC Treaty to State aid in the form of public service compensation granted to certain undertakings entrusted with the operation of services of general economic interest’ are met
