By decision of 3 April 2012 (‘the Opening Decision’), the Commission informed Belgium that it had initiated the procedure laid down in Article 108(2) of the Treaty on the Functioning of the European Union (‘the Treaty’) in respect of the measure and it enjoined Belgium in accordance with Article 11(1) of Council Regulation (EC) No 659/19The Belgian Council of State also pointed to the potential99 of 22 March 1999 laying down detailed rules for the application of Article 108 of the treaty on the functioning of the European Union (3) to suspend the measure until the Commission had decided on its compatibility with the internal market.

I have no regrets about ITER, as you know, but on the other hand, the Belgian Presidency – even if it has gone to enormous effort, I admit – is sugaring the pill for us somewhat today by proposing that we make do with a Council statement, with the wisdom of the Commission – though I hope that it will always be on the side of Parliament; that is its proper place – and with the letter from Mr Leterme, the Prime Minister, which actually proposes that we should respect the treaties.

I would like to point out that Article 203 of the Treaty establishing the European Communities speaks of ‘ministerial rank’ and, both in the meetings of the Councils of Ministers and during the Presidency, there is quite naturally participation by representatives of the Belgian regions or autonomous communities, or whatever you want to call them, and also – as the MEP who spoke about this said earlier – the region or nation of Scotland, the German Länder or the Austrian States and other such examples within the Community.

Declaration No 54 attached to the Treaty of Amsterdam, on subsidiarity, states: –It is taken for granted by the German, Austrian and Belgian governments that action by the European Community in accordance with the principle of subsidiarity not only concerns the Member States but also their entities to the extent that they have their own law-making powers conferred on them under national constitutional law’.

As regards the exemptions permitted by Article 92 (3) (b) of the EEC Treaty, there is nothing in the measure to qualify it as a 'project of common European interest' or as one designed 'to remedy a serious disturbance in the economy of a Member State', the furtherance of which justifies exemption under Article 92 (3) (b) from the prohibition of aids laid down by Article 92 (1). Belgium belongs to the central regions of the Community, whose social and economic problems are not the most serious in the Community, yet where the danger of an escalation of State aid is most immediate and where any State aid is most likely to affect trade between Member States. Available social and economic data on Belgium do not suggest that there is a serious disturbance in the economy of the kind referred to by the Treaty. The Belgian Government's measure was not intended to remedy such a disturbance.
