– (FR) Mr President, I will be brief because I can only express the satisfaction I feel about the way in which Parliament has helped to shed light on this area of law, justice, security and freedom that we wish to build in the Union; I welcome all that has been said, especially on the principle of mutual recognition, which itself brings us back to mutual trust between judges.
− Monsieur le Président, mes propos seront brefs, parce que je ne peux qu’exprimer la satisfaction que m’inspire la manière dont le Parlement a contribué à éclairer cet espace de droit, de justice, de sécurité et de liberté que nous voulons construire dans l’Union; je salue tout ce qui a été dit, notamment sur le principe de reconnaissance mutuelle, qui renvoie lui-même à la confiance mutuelle entre les magistrats.

What seems ironic is that the government does not trust the judiciary's ability to distinguish between offenders who have the ability to pay the surcharge from those for whom the payment represents undue hardship, yet they are continuing to allow judges to increase the surcharge:

The European arrest warrant on its own is not an adequate tool for the creation of a European area of security, freedom and justice, nor will we achieve its proper application unless we substantially strengthen mutual trust between judges, unless we apply minimum common rules to criminal proceedings which safeguard suspects' fundamental rights and unless we achieve a rudimentary approximation of national laws.

For example, I was with the celebrated Judge Bruguiere in France yesterday morning (1025) Mr. Peter MacKay: I suspect and it's what we were told as a committee while visiting your country and meeting with the parliamentary oversight committee as well as the heads of various security agencies, including MI6 and your internal security forces that as a result of your country's history in having to deal with terrorism, arguably for much longer than most countries, a trust has developed between your office and the offices of the parliamentary oversight members, and this is critically important when it comes to the ever-present need to ensure that sensitive information that might imperil ongoing investigations is protected while at the same time you are wearing that very real obligation to ensure that civil liberties are not being abused.

All this takes time, and calls for cooperation between judges and police at international level, together with mutual political trust between governments. It will be a long and difficult process but believe me, it is the only way to defend democracy from fanaticism and barbarism.
Mais pour cela, il faut du temps, il faut que juges et policiers collaborent au niveau international, il faut une confiance politique entre les gouvernements, c’est long et très complexe mais c’est, croyez-moi, Mesdames et Messieurs, le seul moyen efficace, le seul qui nous permettra de protéger la démocratie du fanatisme et de la barbarie.

If, according to the state of which we are nationals we give certain information to a national judge, then clearly if we want to be consistent with the idea of developing this area of freedom, security and justice we must also give it to a judge in the European Union when we are asked for it, because this is the only way we are going to mould this mutual trust between the States in a manner that reaches the citizens.
Si, en accord avec l'État dont nous provenons, nous communiquons certaines informations à un juge national, il est évident que si nous voulons être conséquents avec l'idée de construire cet espace de liberté, de sécurité et de justice, nous devons également les fournir à un juge de l'Union européenne lorsque celui-ci nous les demande, car c'est uniquement de cette façon que nous pourrons développer cette confiance mutuelle entre les États afin qu'elle parvienne jusqu'aux citoyens.
