Nevertheless, two issues merit at least explanatory notes to the text of the two agreements: (a) the fact that the agreement may not involve military tribunals, as called for by the European Parliament in 2001, and (b) the fact that, in the criminal law field, this agreement does not confer most-favoured-nation status on the United States, as is the case with commercial agreements. Accordingly, the final decision will depend on judicial policy considerations of the Member State in question.
8.
