"(14a) In order to allow for a proper democratic oversight of the application of this Regulation, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of necessary amendments and technical adjustments to Annexes I and II following amendments to CN codes and to the TARIC subdivisions, in respect of necessary adjustments following the granting of trade preferences under other arrangements between the Union and the countries and territories covered by this Regulation, and in respect of the suspension of benefits under this Regulation in the event of non-compliance with the condition of effective administrative cooperation in order to prevent fraud, the condition of respect for human rights and the rule of law principles as well as the condition of engaging in effective economic reforms and in regional cooperation.
"(14 bis) Afin de permettre un contrôle démocratique approprié de l'application du présent règlement, il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne en ce qui concerne les modifications et les ajustements techniques nécessaires aux annexes I et II à la suite des changements apportés aux codes NC et aux subdivisions du TARIC, en ce qui concerne les ajustements nécessaires à la suite de l'octroi de préférences commerciales en vertu d'autres accords entre l'Union et les pays et territoires couverts par le présent règlement, et en ce qui concerne la suspension du bénéfice du présent règlement en cas de non-respect de la condition de coopération administrative effective en vue de prévenir la fraude, de la condition de respect des droits de l'homme et des principes de l'état de droit, ainsi que de la condition de pratiquer des réformes économiques efficaces et une coopération régionale.

For that matter, France Télécom has not been compensated for the disadvantages suffered under these arrangements, whereas, as emphasised in its comments, it still has to cope with structural disadvantages, additional costs and inflexibilities on account of the status applicable to the civil servants it employs as regards financial measures associated with departure or return to the public administration, vocational training measures or higher wage cost.
France Télécom n’a d’ailleurs pas été compensée du fait des désavantages subis sous ce régime, alors que, comme le soulignent ses observations, elle supporte encore des désavantages structurels, des surcoûts et rigidités du fait du statut applicable aux fonctionnaires qu’elle emploie pour ce qui est de leviers financiers d’accompagnement des départs ou les retours vers l’administration, d’efforts en matière de formation professionnelle ou de coût salarial supérieur.
