With regard to the contribution promised by the Land of Berlin in the refund agreement, it should be noted first of all that this will apply only if the Commission concludes the LBB/IBB proceeding (20) with a recovery decision and if, in this case too, only the necessary amount of the reorganisation grant is paid, in order to avoid undershooting the capital ratios mentioned in the agreement in the case of LBB and/or the BGB group.
En ce qui concerne l'apport promis par le Land de Berlin dans l'accord de remboursement, il y a lieu d'observer tout d'abord qu'il ne sera applicable que si la Commission clôt la procédure C 48/02 («LBB/IBB») (20) par une décision de remboursement et que même dans ce cas, seule est payée la fraction de la subvention de réorganisation qui est nécessaire pour éviter que LBB et/ou le groupe BGB ne descende sous les ratios de fonds propres prévus dans l'accord.
