IN-CONTEXT TRANSLATIONS

In order to ensure trade mark protection and combat counterfeiting effectively, and in line with international obligations of the Union under the framework of the World Trade Organisation (WTO), in particular Article V of the General Agreement on Tariffs and Trade (GATT) on freedom of transit and, as regards generic medicines, the ‘Declaration on the TRIPS Agreement and public health’ adopted by the Doha WTO Ministerial Conference on 14 November 2001, the proprietor of an EU trade mark should be entitled to prevent third parties from bringing goods, in the course of trade, into the Union without being released for free circulation there, where such goods come from third countries and bear without authorisation a trade mark which is identical or essentially identical with the EU trade mark registered in respect of such goods.
Afin d'assurer la protection conférée par la marque et de lutter efficacement contre la contrefaçon, et conformément aux obligations internationales auxquelles est soumise l'Union dans le cadre de l'Organisation mondiale du commerce (OMC), en particulier l'article V de l'accord général sur les tarifs douaniers et le commerce (GATT) relatif à la liberté de transit et, pour ce qui est des médicaments génériques, la «Déclaration sur l'accord sur les ADPIC et la santé publique» adoptée lors de la conférence ministérielle de l'OMC à Doha, le 14 novembre 2001, il convient de permettre au titulaire d'une marque de l'Union européenne d'empêcher des tiers d'introduire dans l'Union, dans la vie des affaires, des produits sans qu'ils y soient mis en libre pratique, lorsque ces produits viennent d'un pays tiers et portent sans autorisation une marque identique ou pour l'essentiel identique à la marque de l'Union européenne enregistrée pour ces produits.

(14) Since the objective of this Regulation, namely to define the modalities for reaching the 2020 target to reduce CO 2 emissions from new light commercial vehicles, cannot be sufficiently achieved by the Member States but can rather, by reason of its scale and effects, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

Considers the allocated amount in chapter 14, and in particular the moderate increase in chapter 14 04 for the 2013 Customs Programme, to be appropriate to achieve goals in this policy area; points out the importance of that Programme for meeting the challenges of the enlarged European Union, in particular after the accession of Romania and Bulgaria; appreciates the goal of sharing experience and knowledge with and between customs administrations and deems the security and safety of citizens to be strengthened thereby;

(3) Burden-sharing between Member States and the European Union in the management of external borders is one of the five components of the common policy for the management of the external borders, as proposed by the Commission in its Communication of 7 May 2002 "Towards integrated management of the external borders of the Member States of the European Union" and endorsed by the Council in its "Plan for the management of the external borders of the Member States of the European Union" of 14 June 2002.
