IN-CONTEXT TRANSLATIONS

In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Union (TFEU) should be delegated to the Commission in respect of the accreditation of the paying agencies and coordinating bodies, the obligations of the paying agencies in relation to public intervention, as well as the rules on the content of the management and control responsibilities of those agencies, the measures to be financed by the general budget of the European Union (the Union's budget) under public intervention and the valuation of the operations in connection with public intervention.
Afin de compléter ou de modifier certains éléments non essentiels du présent règlement, il importe de conférer à la Commission le pouvoir d'adopter des actes délégués conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne, en ce qui concerne l'agrément des organismes payeurs et des organismes de coordination, les obligations des organismes payeurs en ce qui concerne l'intervention publique, ainsi que les règles sur la teneur de leurs responsabilités en matière de gestion et de contrôle de ces organismes, les mesures à financer sur le budget général de l'Union européenne (ci-après dénommé "budget de l'Union") au titre de l'intervention publique et l'évaluation des opérations y afférentes.

4. Notes that the Union general budget for 2012 totalled EUR 148 200 million in commitment appropriations, of which Parliament's budget accounted for EUR 1 718 million; notes, furthermore, that this figure represents just over 1 % of the Union general budget and amounts to 20 % of the amount of EUR 8 278 million set aside for the 2012 administrative expenditure of the Union institutions as a whole; notes that this is in line with the Interinstitutional Agreement between Parliament, the Council and the Commission on budgetary discipline, and sound financial management covering expenditure on buildings and infrastructure, staff salaries and pensions, information technology, and security;
4. relève que le budget général de l’Union pour l’exercice 2012 s’est chiffré à un total de 148 200 millions d'EUR en crédits d’engagement, dont le budget du Parlement représentait 1 718 millions d'EUR; constate, en outre, que ce chiffre représente juste un peu plus de 1 % du budget général de l'Union et 20 % du montant de 8 278 millions d'EUR affecté en 2012 aux dépenses administratives des institutions de l'Union dans leur ensemble; observe que la somme en question est conforme à l'accord interinstitutionnel entre le Parlement européen, le Conseil et la Commission sur la discipline budgétaire et la bonne gestion financière pour la prise en charge des dépenses relatives aux bâtiments et aux infrastructures, aux rémunérations et aux pensions du personnel, à l'informatique et à la sécurité;

Regulation (EC, Euratom) No 1605/2002 laid down the budgetary principles and financial rules governing the establishment and implementation of the general budget of the Union (the "budget"), ensuring sound and effective management, control and protection of the Union's financial interests and increasing transparency, that are to be respected in all legal acts and by all institutions.

6. For the purposes of this Article, ‘irregularity’, shall mean any infringement of a provision of Union law, or any breach of a contractual obligation resulting from an act or omission by an economic operator which has, or would have, the effect of prejudicing the general budget of the Union or budgets managed by the Union by an unjustified item of expenditure.
6. Aux fins du présent article, on entend par «irrégularité» toute infraction à une disposition du droit de l'Union, ou toute violation d'une obligation contractuelle résultant d'un acte ou omission d'un opérateur économique qui a ou aurait pour effet de porter préjudice au budget général de l'Union ou aux budgets gérés par l'Union par un poste de dépense injustifié.

2. Believes that since Article 335 of the Treaty on the Functioning of the European Union recognises that Union institutions possess a certain administrative autonomy in their operation, this autonomy implies a corresponding degree of responsibility and accountability; whereas Parliament is the sole directly elected body, and one of its tasks is, acting on the Council's recommendation, to give discharge in respect of the implementation of the Union general budget, Parliament has decided to reflect this autonomy in the discharge procedure, and to set apart the sections of the general budget which are autonomously administered by each of the other Union institutions, and to give discharge to each of those institutions;

For the Union actions financed under this Decision, OLAF has the power to carry out investigations on the basis of Regulation (EC, Euratom) No 2988/95 and Regulation (Euratom, EC) No 2185/96, which shall apply to any infringement of a provision of Union law, including infringements of a contractual obligation stipulated on the basis of the Facility, resulting from an act or omission by an economic operator, which has, or would have, the effect of prejudicing the general budget of the European Union or budgets managed by it, by an unjustified item of expenditure.

En ce qui concerne les actions de l'Union financées dans le cadre de la présente décision, l'OLAF dispose d'un pouvoir d'enquête sur la base des règlements (CE, Euratom) no 2988/95 et (Euratom, CE) no 2185/96, qui s'applique à toute violation d'une disposition du droit de l'Union, y compris aux violations d'obligations contractuelles stipulées sur la base de l'instrument, résultant d'un acte ou d'une omission d'un opérateur économique qui a ou aurait pour effet de porter préjudice, par une dépense indue, au budget général de l'Union européenne ou à des budgets gérés par celle-ci.

reminds the Bureau, in this context, of its comments in respect of Section I - European Parliament set out in its resolution of 25 October 2007 on the draft general budget of the European Union for the financial year 2008, and its resolution of 26 September 2006 with comments forming an integral part of the decision on the discharge for implementation of the European Union general budget for the financial year 2004, Section I — European Parliament; asks the competent authorities to report back to the Committee on Budgetary Control on progress achieved before the end of 2008;

For the Union actions financed under this Decision, Regulation (EC, Euratom) No 2988/95 and Regulation (Euratom, EC) No 2185/96 shall apply to any infringement of a provision of Community law, including infringements of a contractual obligation stipulated on the basis of the Programme, resulting from an act or omission by an economic operator, which has, or would have, the effect of prejudicing the general budget of the European Union or budgets managed by it, by an unjustified item of expenditure.
