In order to allow for a swift Union response to changing circumstances as regards the assessment of the sensitivity of exports under Union General Export Authorisations, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of amending Annex II to Regulation (EC) No 428/2009 as regards the removal of destinations from the scope of the Union General Export Authorisations.
Afin de permettre à l’Union de réagir rapidement à des changements concernant l’évaluation du caractère sensible des exportations soumises à des autorisations générales d’exportation de l’Union, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne aux fins de la modification de l’annexe II du règlement (CE) no 428/2009 en ce qui concerne le retrait de destinations du champ d’application des autorisations générales d’exportation de l’Union.

Given the nature of such Union General Export Authorisations, there may be a need to remove certain destinations from the scope of those authorisations, in particular if changing circumstances show that facilitated export transactions should no longer be authorised under a Union General Export Authorisation for a particular destination.

‘In order to ensure that only low-risk transactions are covered by the Union General Export Authorisations included in Annexes IIa to IIf, the Commission shall be empowered to adopt delegated acts in accordance with Article 23a to remove destinations from the scope of those Union General Export Authorisations, if such destinations become subject to an arms embargo as referred to in Article 4(2).

(8) Afin de permettre à l’Union de réagir rapidement aux changements de circonstances concernant l’évaluation de la sensibilité d’exportations soumises à des autorisations générales d’exportation de l’Union, il convient de déléguer à la Commssion le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne aux fins de la modification des annexes IIa à IIf du règlement (CE) n° 428/2009 en ce qui concerne le retrait de destinations ou biens du champ d’application desdites autorisations.

Where, in the case of a significant change of circumstances as regards the assessment of the sensitivity of exports under a Union General Export Authorisation included in Annexes IIa to IIf, imperative grounds of urgency require a removal of particular destinations or items from the scope of a Union General Export Authorisation, the procedure provided for in Article 23b shall apply to delegated acts adopted pursuant to this Article.

This authorisation can only be used when the initial export has taken place under a Union General Export Authorisation or an initial export authorisation has been granted by the competent authorities of the Member State where the original exporter was established for the export of the items which have subsequently been reimported into the customs territory of the European Union for the purposes of maintenance, repair or replacement.

It is desirable to achieve uniform and consistent application of controls throughout the Union in order to avoid unfair competition among Union exporters, harmonise the scope of Union General Export Authorisations and conditions of their use among Union exporters and ensure efficiency and effectiveness of the security controls in the Union.
Il est souhaitable d’aboutir à une application uniforme et cohérente des contrôles dans l’ensemble de l’Union afin d’éviter une concurrence déloyale entre les exportateurs européens, d’harmoniser la portée des autorisations générales d’exportation de l’Union et les conditions de leur utilisation par ces derniers, ainsi que de garantir l’efficacité et l’effectivité des contrôles de sécurité dans l’Union.
