In an effort to urge Romania to speed up the process, the Commission is bringing the Romanian authorities before the Court of Justice of the EU.

By letters of 5 July 2007 and 30 July 2007, the Commission urged the Romanian authorities to annul specific conditions attached to the privatisation contract of Tractorul, indicating at the same time that the failure to suspend any unlawful aid might lead the Commission to adopt a decision on the basis of Article 88(2) of the EC Treaty and of Article 11(1) of Council Regulation (EC) No 659/1999 of 22 March 1999 laying down detailed rules for the application of Article 93 of the EC Treaty (2) (suspension injunction).

12. Urges the Romanian Government to consolidate the reforms it has undertaken, and urges the Romanian authorities to step up their efforts, particularly in the fields of child protection, integration of minorities, in particular the Roma and Hungarian minorities, and the treatment of the mentally handicapped; calls on Romania in this respect to take immediate steps to remedy the shortcomings by fulfilling the requirements of the Commission's 2005 and 2006 Comprehensive Monitoring Reports and Parliament's resolutions adopted in 2004 and 2005;
12. encourage le gouvernement roumain à consolider les réformes entreprises et invite les autorités roumaines à intensifier leurs efforts, tout particulièrement dans les domaines de la protection de l'enfance, de l'intégration des minorités, notamment les minorités rom et hongroise, et du traitement du handicap mental; invite à cet égard la Roumanie à prendre des mesures immédiates pour combler les lacunes en satisfaisant aux exigences figurant dans les rapports globaux de suivi de la Commission pour 2005 et 2006 ainsi que dans les résolutions du Parlement européen adoptées en 2004 et en 2005;

Supports Romania's efforts to root out the high level of corruption in state and society; strongly urges the Romanian Government to make use of the cooperation agreement it concluded with Europol on 13 May 2003 to render the fight against corruption more effective; takes the resignation of three ministers on 20 October 2003 to be a sign that this issue is taken seriously by the highest level of government; is, however, concerned that in general the services within the administration responsible for corruption appear to be too passive in investigating such cases; acknowledges that the legal framework to fight corruption is in place and calls on the Romanian authorities to focus attention on the enforcement of the existing legislation; in this context urges the government to further increase the staff at the National Anti-Corruption Prosecutor's Office and to give permanent status to all of the prosecutors rather than having them seconded by other government bodies; asks the government to provide further training for all the staff as well as to strengthen the office's operational independence, in particular by eliminating the responsibility of political appointees and politicians to decide on the launching of anti-corruption investigations; notes that first and foremost there must be the political will to eradicate corruption, for only this will lead to a change in attitudes;
7. soutient la Roumanie dans ses tentatives d'éradication du haut niveau de corruption dans l'État et la société; invite instamment le gouvernement roumain à utiliser l'accord de coopération qu'il a conclu le 13 mai 2003 avec Europol pour rendre plus efficace la lutte contre la corruption; considère la démission de trois ministres le 20 octobre 2003 comme un signal indiquant que cette question est prise au sérieux au plus haut niveau de l'État; se montre toutefois préoccupé par la passivité excessive dont semblent en général faire preuve les services de l'administration chargée des questions de corruption dans leurs enquêtes sur de telles affaires; reconnaît que le cadre juridique de lutte contre la corruption est en place et invite les autorités roumaines à concentrer leur attention sur la mise en œuvre de la législation existante; à cet égard, prie instamment le gouvernement d'augmenter encore les effectifs de l'office national de lutte contre la corruption et d'accorder à tous les procureurs un statut permanent plutôt que de les détacher d'autres administrations; demande au gouvernement d'offrir des formations supplémentaires à l'ensemble du personnel, ainsi que de renforcer l'indépendance opérationnelle de cet office, en particulier en enlevant aux hauts fonctionnaires et aux hommes politiques la responsabilité de décider de l'ouverture d'enquêtes en matière de corruption; rappelle qu'il importe avant tout qu'une volonté politique d'éradiquer la corruption soit présente, car c'est la seule façon de faire évoluer les mentalités;

The Vice-President also indicated that the Commission is ready to consider proposing further assistance for Romania and he urged the Romanian authorities to immediately complete the agreed prior actions.
Le vice-président a ajouté que la Commission est prête à prendre en considération une nouvelle aide à la Roumanie et il a invité les autorités roumaines à mettre en oeuvre immédiatement toutes les mesures préalables convenues.
