IN-CONTEXT TRANSLATIONS

1. An additional import duty shall apply to imports, subject to the rate of duty laid down in Article 70(1), of grape juice and grape must where marked with a special safeguard clause indication (SSG) in the Agreement on Agriculture concluded during the Uruguay Round Multilateral Trade Negotiations, in order to prevent or counteract adverse effects on the market of the Community which may result from those imports, if:

5 Article 2(1) of the Agreement on Trade-Related Aspects of Intellectual Property Rights (‘the TRIPs Agreement’), which constitutes Annex 1C to the Agreement establishing the World Trade Organisation, signed in Marrakesh on 15 April 1994 and approved by Council Decision 94/800/EC of 22 December 1994 concerning the conclusion on behalf of the European Community, as regards matters within its competence, of the agreements reached in the Uruguay Round multilateral negotiations (1986-1994) (OJ 1994 L 336, p. 1), provides:
L’article 2, paragraphe 1, de l’accord sur les aspects des droits de propriété intellectuelle qui touchent au commerce (ci-après l’«accord ADPIC»), qui constitue l’annexe 1 C de l’accord instituant l’Organisation mondiale du commerce, a été signé à Marrakech le 15 avril 1994 et approuvé par la décision 94/800/CE du Conseil, du 22 décembre 1994, relative à la conclusion au nom de la Communauté européenne, pour ce qui concerne les matières relevant de ses compétences, des accords des négociations multilatérales du cycle de l’Uruguay (1986-1994) (JO L 336, p. 1), dispose:

‘Applications for licences and licences with advance fixing of the refund which are drawn up in connection with a food-aid operation within the meaning of Article 10(4) of the Agreement on Agriculture, concluded as part of the Uruguay Round of multilateral trade negotiations, shall contain in section 20 at least one of the entries listed in Annex Ib’.

(14) Council Decision 94/800/EC of 22 December 1994 concerning the conclusion on behalf of the European Community, as regards matters within its competence, of the Agreements reached in the Uruguay Round multilateral negotiations (1986 to 1994)(10), approved in particular the WTO Agreement on Government Procurement (hereinafter referred to as the "Agreement"), the aim of which is to establish a multilateral framework of balanced rights and obligations relating to public contracts with the aim of achieving the liberalisation and expansion of world trade.

There is, of course, the World Trade Organisation, which requires that we observe certain rules. If one considers the governments that took part in the negotiations from 1986 to 1994 in the Marrakech Round and the Uruguay Round and which ones then signed the treaties at the end of 1993 or 1994, there were abstentions in many areas.
Il y a effectivement l’organisation mondiale du commerce qui nous impose de respecter certaines règles de jeu. Que l’on se rappelle un peu quels étaient les gouvernements de 1986 à 1994 qui ont participé aux négociations de l’Accord de Marrakech et de l’accord de l’Uruguay Round et quels sont ceux qui, fin 1993 ou en 1994, ont signé les accords. Il y a eu des abstentions dans de nombreux secteurs.

B. pointing out that that failure was easily foreseeable, given the strangely precipitate way in which the event was organised, the absence of a review of the previous Uruguay Round and the decision to go for comprehensive negotiations in which the maximalist American pre-electoral stance was going to come up against the compromise position of the EU Member States (which had already made as many concessions as were feasible in this connection) and that of the emerging and developing countries, who were tired of not being listened to enough,

– (ES) Mr President, ladies and gentlemen, it is reassuring to know that in negotiations as important as those with the World Trade Organisation, the Fifteen Member States have adopted a common position in order to establish, in the area of agriculture, stable ground rules which will allow fair trading on the world scene and to face the challenges of the new Millennium with a clear purpose. We can do this because we have based our position on those adopted at the time from the agenda of the agriculture agreement of the Uruguay Round and at Agenda 2000 in Berlin, as well as on maintaining the multifunctional nature of agriculture

The situation in the agricultural and food-processing sectors has become more serious over the last few years, although we were theoretically covered by the Uruguay Round and the Marrakech Agreements, which were supposed to guarantee and organise access to the market, support for exports and internal support.

In order to comply with the new provisions of the Uruguay Round, which gave rise to the World Trade Organization, Canada decided to transform its farm product quotas into tariff quotas, thus complying with the provisions of the Uruguay Round.
