1. Where, having carried out an evaluation under Article 35(1), a Member State finds that although a vessel is in compliance with this Directive, it presents a risk to the health or safety of persons, to domestic animals or property , it shall require the relevant economic operator to take all appropriate measures to ensure that the vessel concerned, when placed on the market, no longer presents that risk, to withdraw the vessel from the market or to recall it within a reasonable period, commensurate with the nature of the risk, as it may prescribe.

3. Where the flag Member State has adopted national provisions in the form of a national fishing authorisation scheme for the allocation to individual vessels of the fishing opportunities available to it, it shall send to the Commission at its request information on the fishing vessels authorised to engage in a fishing activity in a given fishery, in particular concerning the external identification number, the name of the fishing vessels concerned, and the individual fishing opportunities allocated to them.
3. Dans le cas où l’État membre du pavillon a adopté, sous la forme d’un régime d’autorisation de pêche national, des dispositions nationales relatives à l’octroi aux navires individuels des possibilités de pêche dont il dispose, il communique à la Commission, à la demande de celle-ci, les informations relatives aux navires de pêche autorisés à exercer une activité de pêche dans une pêcherie déterminée, en particulier en ce qui concerne le numéro d’identification externe, les noms des navires de pêche concernés et les possibilités de pêche individuelles qui leur sont attribuées.

2. Member States shall endeavour to obtain information on any arrangements, between their nationals and a third country, which allow fishing vessels flying their flag to engage in fishing activities in waters under the jurisdiction or sovereignty of a third country, and shall inform the Commission thereof by the electronic transmission of a list of the vessels concerned.

Les États membres s'efforcent de se tenir informés de tout accord entre leurs ressortissants et un pays tiers permettant à des navires de pêche battant leur pavillon d'exercer des activités de pêche dans des eaux relevant de la juridiction ou de la souveraineté d'un pays tiers; ils en informent la Commission en lui communiquant par voie électronique la liste des navires concernés.

2. Before placing any fishing vessel on the Community IUU vessel list, the Commission shall provide the owner and, where appropriate, the operator of the fishing vessel concerned with a detailed statement of reasons for the intended listing and with all elements supporting the suspicion that the fishing vessel has carried out IUU fishing.

Where the fishing authorisation is definitively withdrawn by the authorising authorities of a third country, the flag Member State shall immediately withdraw the fishing permit granted to the vessel concerned under the agreement concerned.

At the latest five working days before the deadline for the transmission of applications laid down in the agreement concerned or, in the absence of a deadline in the agreement, at the latest in accordance with the arrangement set out in the agreement and without prejudice to specific provisions contained in Community legislation, Member States shall submit to the Commission, through electronic transmission, the applications for fishing authorisations for the fishing vessels concerned.

(b) that during the previous 12 months of fishing activities under the agreement concerned or, in case of a new agreement, of fishing activities of the agreement that preceded that agreement, have committed a serious infringement, or, where appropriate, have not yet fulfilled the conditions under that agreement for that period except where a penalty has already been imposed on the vessel concerned, where there is evidence that the infringement was not serious, and/or where the owner of the vessel has changed and the new owner provides guarantees that the conditions will be fulfilled.

At present, Article 3, which applies only to vessels of under 12 metres, allows for an increase in the aggregate capacity of this segment in the context of frameworks for improving safety of navigation at sea and Article 4 allows for an increase in the objectives equivalent to increases in capacity resulting exclusively from safety improvements, on a case-by-case basis, where these do not increase the fishing effort of the vessels concerned.
Actuellement, l'article 3 qui s'applique aux navires de moins de 12 mètres, autorise une augmentation de la capacité globale de ce segment dans le cadre de programmes d'amélioration de la sécurité de la navigation en mer. L'article 4 autorise une augmentation des objectifs équivalente aux augmentations de capacité résultant exclusivement des améliorations en matière de sécurité, au cas par cas, lorsqu'elles n'entraînent pas une augmentation de l'effort de pêche des navires concernés.
