His Excellency the Governor General in Council, on the recommendation of the Minister of Veterans Affairs, pursuant to section 45 of the Veterans Review and Appeal Board ActFootnote , is pleased hereby to repeal the Veterans Appeal Board Regulations, made by Order in Council P.C. 1987-2146 of October 15, 1987Footnote , and to make the annexed Regulations prescribing the procedure in respect of applications and appeals to the Veterans Review and Appeal Board, in substitution therefor.

111. The Veterans Review and Appeal Board may, on its own motion, reconsider any decision of the Veterans Appeal Board, the Pension Review Board, the War Veterans Allowance Board, or an Assessment Board or an Entitlement Board as defined in section 79 of the Pension Act, and may either confirm the decision or amend or rescind the decision if it determines that an error was made with respect to any finding of fact or the interpretation of any law, or may, in the case of any decision of the Veterans Appeal Board, the Pension Review Board or the War Veterans Allowance Board, do so on application if new evidence is presented to it.
111. Le Tribunal des anciens combattants (révision et appel) est habilité à réexaminer toute décision du Tribunal d’appel des anciens combattants, du Conseil de révision des pensions, de la Commission des allocations aux anciens combattants ou d’un comité d’évaluation ou d’examen, au sens de l’article 79 de la Loi sur les pensions, et soit à la confirmer, soit à l’annuler ou à la modifier comme s’il avait lui-même rendu la décision en cause s’il constate que les conclusions sur les faits ou l’interprétation du droit étaient erronées; s’agissant d’une décision du Tribunal d’appel, du Conseil ou de la Commission, il peut aussi le faire sur demande si de nouveaux éléments de preuve lui sont présentés.

(2) Proceedings pending before the Veterans Appeal Board on the day on which section 105 of this Act comes into force shall be taken up and continued under and in conformity with the Veterans Review and Appeal Board Act, as enacted by this Act, and the Pension Act, as amended by this Act, before an appeal panel of the Veterans Review and Appeal Board established in accordance with section 27 of the Veterans Review and Appeal Board Act.

Thus, for the purposes of Annex X to Regulation (EC) No 4/2009 established by the Commission Implementing Regulation (Article 2(2) of Regulation (EC) No 4/2009), the relevant Danish administrative authorities are: The Regional State Administration (Statsforvaltningen) and the Ministry of Social Affairs, Children and Integration (the National Social Appeals Board, Division of Family Affairs) (Social-, Børne- og Integrationsministeriet (Ankestyrelsen, Familieretsafdelingen)).

(34) In order to allow for an effective, efficient and complete review of decisions of the Agency by the Boards of Appeal by means of a transparent, thorough, fair and equitable procedure which takes into account the principles laid down in Regulation (EC) No 207/2009, the power to adopt delegated acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of specifying the details on the content of the notice of appeal, the procedure for the filing and examination of an appeal, the content and form of the Board of Appeal's decisions and the reimbursement of the appeal fees.
(34) Pour que les chambres de recours puissent examiner les décisions de l'Agence de manière efficace, efficiente et exhaustive et selon une procédure transparente, rigoureuse, juste et équitable, qui tienne compte des principes dans le règlement (CE) n° 207/2009, il convient de déléguer à la Commission le pouvoir d'adopter, conformément à l'article 290 du traité, des actes délégués précisant les détails relatifs au contenu de l'acte de recours, à la procédure de dépôt et d'examen des recours, au contenu et à la forme des décisions des chambres de recours ainsi qu'au remboursement des taxes de recours.

(45) In order to ensure an effective and efficient method to resolve disputes, to ensure consistency with the language regime laid down in Regulation (EC) No 207/2009, the expeditious delivery of decisions on a simple subject matter, and the effective and efficient organisation of the Boards of Appeal, and to guarantee an appropriate and realistic level of fees to be charged by the Agency, while complying with the budgetary principles set out in Regulation (EC) No 207/2009, the power to adopt delegated acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of specifying the details on the languages to be used before the Agency, the cases where opposition and cancellation decisions should be taken by a single member, the details on the organisation of the Boards of Appeal, the amounts of the fees to be paid to the Agency and details related to their payment.
(45) Afin de mettre en place une méthode efficace et efficiente de règlement des litiges et d'en assurer la cohérence avec le régime linguistique prévu par le règlement (CE) n° 207/2009, ainsi que l'adoption rapide des décisions portant sur des affaires simples et une organisation efficace et efficiente des chambres de recours, et pour garantir que les redevances perçues par l'Agence se situent à un niveau adapté et réaliste, tout en respectant les principes budgétaires énoncés dans le règlement (CE) n° 207/2009, il convient de déléguer à la Commission le pouvoir d'adopter, conformément à l'article 290 du traité, des actes délégués indiquant précisément les langues à employer avec l'Agence, les cas dans lesquels les décisions des divisions d'opposition et d'annulation doivent être prises par un seul membre, les détails de l'organisation des chambres de recours, le montant des taxes à verser à l'Agence et les modalités détaillées de leur versement.

When making public its decision as referred to in the first subparagraph, ESMA shall also make public the right of the trade repository concerned to appeal the decision, the fact, where relevant, that such an appeal has been lodged, specifying that such an appeal does not have suspensive effect, and the fact that it is possible for ESMA’s Board of Appeal to suspend the application of the contested decision in accordance with Article 60(3) of Regulation (EU) No 1095/2010.

Pleas in law: Infringement of Article 8(1)(b) of Regulation No 207/2009 in that the Board of Appeal did not accept a similarity between the ‘restaurant services (food)’ designated in Class 43 in the mark applied for and the ‘mineral water and aerated waters and other non-alcoholic drinks; syrup and other preparations to make beverages’ designated in the ‘SPA’ word mark registered in Benelux; infringement of Article 8(5) of Regulation No 207/2009 in that the Fourth Board of Appeal did not accept the existence of a ‘link’ between the ‘SPA’ mark in Class 32 and the ‘THAI SPA’ mark in Class 43; and infringement of the rights of the defence and of Article 75 of Regulation No 207/2009.

Mr. Bob Ringma (Nanaimo-Cowichan, Ref.): Mr. Speaker, because there has been a lapse of several days I remind all that Bill C-67 is the Veterans Appeal and Review Board Act and that the purpose of Bill C-67 is to reduce the existing backlog of appeal pension cases and to shorten decision time on first application (1520 ) If it succeeds it will merge two existing bodies, the Canadian Pension Commission and the Veterans Appeal Board, and first decisions on veterans cases will be made by the Department of Veterans Affairs, and the bureau of pension advocates will become part of the department and will work only on preparation of appeals.
