In its last Turco-Von Boetticher Recommendation to the Council, the EP demanded that the latter adopt a provision guaranteeing a level of data protection and controls on the respect of such rules, equivalent to the level guaranteed in the first pillar (EP and Council Directive 95/46/EC), and the gathering of data concerning the development of organised crime, which should be included in the annual reports to be forwarded to the EP.
Dans sa dernière recommandation Turco‑von Boetticher au Conseil, le PE demandait que soit adoptée une disposition visant à garantir un niveau de protection des données et de contrôle quant au respect de ces normes équivalent à ce qui est garanti dans le premier pilier (directive 95/46/CE du Parlement européen et du Conseil) et que les rapports annuels à transmettre au Parlement contiennent des données au sujet de l'évolution de la criminalité organisée.

Nonetheless, the von Boetticher report eventually rejects this initiative. The reasons given are typical of the European Parliament’s approach. It is against a protocol that would amend a convention. I refer to intergovernmental legal instruments respecting national sovereignty. It argues for a European constitution to be adopted first. It is hoped such a constitution would allow all these amendments to be handled by means of a qualified majority of members in the framework of the Community system.
Mais finalement, il rejette néanmoins cette initiative pour des raisons typiques de la démarche habituelle du Parlement européen : il ne veut pas d'un protocole qui amenderait une convention (instruments juridiques intergouvernementaux respectueux des souverainetés nationales), mais il veut d'abord que soit adoptée une constitution européenne qui, espère-t-il, permettrait d'opérer toutes ces modifications à la majorité qualifiée des membres, dans le cadre du système communautaire.
