Consequently, the Court of Justice finds that the General Court was fully entitled, without distorting the national law , to infer from it that, irrespective of the sector in which that renown was acquired and even where the name of the well-known person has already been registered or used as a trade mark, the proprietor of a well-known name is entitled to prevent the use of that name as a trade mark where he has not given his consent to its registration as a trade mark.

(18) In particular the Commission should be empowered to adapt to technical progress the list of fibre names and the related descriptions, the minimum requirements for the technical file to be annexed to the application by the manufacturer for the addition of a new fibre name to the list of permitted fibre names, the special provisions concerning corsetry products and certain types of textiles, the list of products for which labelling or marking is not mandatory, the list of products for which only inclusive labelling or marking is mandatory, the list of items not to be taken into account for the determination of fibre percentages, the agreed allowances used to calculate the mass of fibres contained in a textile product, as well as to adapt the existing or to adopt new methods of quantitative analysis for binary and ternary mixtures.

Points out, in this respect, that a number of countries, including the United States, the Russian Federation and China, as well as certain EU Member States, have already recognised the Former Yugoslav Republic of Macedonia by its constitutional name; recalls that some of those countries have repeatedly stated that they will accept the possible outcome of negotiations regarding the name issue under the aegis of the UN; takes the view that, pursuant to the provisions of the Interim Accord of 1995, the name issue is not an obstacle to the opening of negotiations for EU accession and that, as is the case for all other candidate countries, its integration into the EU will depend exclusively on fulfilment of the Copenhagen criteria, the conditions of the stabilisation and association framework, and the EU´s capacity to integrate new Member States;

Welcomes the Commission's positive reply to Parliament's repeated demands - namely those expressed in paragraph 102 of its above-mentioned resolution on the discharge for 2001 - for public disclosure of the amounts received by and the names of the beneficiaries under the EU budget, as proposed in the European Transparency Initiative (COM(2006)0194 - SEC(2005)1300); regrets, however, that the equivalent information regarding recoveries of Community funds is excluded from the European Transparency Initiative; calls on the Commission to make available to the budgetary authority and ultimately to the public the names and amounts of recoveries due under or credited to the EU budget, as well as the final destination of these sums;

However, I have now spoken about updating the VAT system, which means that I can now turn to Mr Helmer and say that I am well aware that these are sensitive issues, I am well aware of the importance accorded to taxation, in the name of national sovereignty, and to the matter of voting upon taxes and, in particular, upon the rates of taxation. After all, I did have a seat in the parliament of my own country for twenty-two years.
