It is clear from the wording of the vacancy notice that both the list of eligibility criteria it contained and the selection criteria were the same for EU officials and for staff from national diplomatic services of the Member States, the only difference being that the latter were required to meet nationality and education criteria which officials in function group AD were presumed to have met at the time of their recruitment.
Il ressort du libellé de l’avis de vacance que tant la liste des conditions d’admission prévues que les critères de sélection étaient les mêmes pour les fonctionnaires de l’Union et pour les membres du personnel des services diplomatiques nationaux des États membres, la seule différence consistant à exiger de ces derniers des conditions relatives à la nationalité et au niveau d’enseignement que les fonctionnaires du groupe de fonctions AD sont censés remplir lors de leur recrutement.

Although those figures do not match exactly the number of EEAS officials in each grade, since some of those officials were not eligible for promotion during that promotion procedure, they provide adequate proof that, although the vacancy notice had confined the opportunity to apply for the vacant post solely to EEAS officials in grade AD 5, nearly all EEAS officials would have been excluded from the selection procedure, in view of the high grades occupied by all those officials.
S’il est vrai que ces chiffres ne coïncident pas exactement avec le nombre de fonctionnaires du SEAE classés dans chaque grade, puisque certains de ces fonctionnaires n’étaient pas promouvables lors dudit exercice de promotion, ils prouvent à suffisance de droit que, si l’avis de vacance avait limité aux seuls fonctionnaires du SEAE de grade AD 5 la possibilité de présenter leur candidature au poste à pourvoir, la presque totalité des fonctionnaires du SEAE aurait été exclue de la procédure de sélection, au vu du grade élevé auquel tous ces fonctionnaires sont classés.

Fourthly and lastly, it is not possible to accept the applicant’s arguments that the contested grading decision is unlawful, that is to say, first, that the vacancy notice allowed officials in a range of grades from grade AD 5 to grade AD 14 to apply for the post and, secondly, that officials who were working, or had worked, in the same service as the applicant and had presumably performed the same functions, were in a higher grade than the one at which the applicant was recruited.
En quatrième et dernier lieu, sont également voués à l’échec les arguments du requérant à l’appui de l’illégalité de la décision de classement attaquée, tirés, le premier, de ce que l’avis de vacance permettait à des fonctionnaires classés dans un éventail de grades allant du grade AD 5 au grade AD 14 de postuler et, le second, de ce que des fonctionnaires travaillant ou ayant travaillé dans le même service que le requérant et ayant supposément exercé les mêmes fonctions étaient classés à un grade plus élevé que celui auquel il a été classé.

Accordingly, whilst there were three possible categories of candidates, namely, those who were EU officials, those who had already been recruited to the EEAS as temporary staff within the meaning of Article 2(e) of the CEOS and those who, like the applicant, did not come within either of those categories, the vacancy notice provided that the successful candidate would, in the case of an EU official, be recruited at his existing grade and, in the case of the others, that is to say staff from the national diplomatic services of the Member States, at grade AD 5.
Partant, alors qu’il y avait trois catégories possibles de candidats, à savoir ceux qui étaient des fonctionnaires de l’Union, ceux qui avaient déjà été recrutés au SEAE en tant qu’agents temporaires au sens de l’article 2, sous e), du RAA et ceux qui, comme le requérant, ne rentraient ni dans l’une ni dans l’autre de ces catégories, l’avis de vacance a prévu que le classement en grade du candidat retenu se ferait, pour les fonctionnaires de l’Union, au grade qu’ils détenaient et, pour les autres, c’est-à-dire pour les membres du personnel des services diplomatiques nationaux des États membres, au grade AD 5.
