The two Commission proposals underlying this report were pending when the Treaty of Lisbon entered into force on 1 December 2009. The particular features of the outermost regions were recognised by the authors of the Maastricht Treaty in Declaration No 26, enshrined in the Treaty of Amsterdam (Article 299(2) quoted above), which introduced a specific legal basis for the outermost regions, and recently confirmed in the Treaty establishing a Constitution. They provide the basis for positive differentiation at Community level for these regions with a view to their development and convergence with the rest of the EU.

The discussions have divided MEPs into two camps: on the one hand, there were those who hid behind the Treaties in order to justify the faint-hearted position they had adopted and, on the other hand, there were those who were concerned, above all, with people’s daily lives and health.

The current publication practices are so inadequate and there is so little transparency that no treaty is reproduced in the Canada Gazette except for extradition treaties and that only 32 of the 34 treaties on which measures were taken in 1999 were published in the Canada Treaties Series. I checked this a few hours ago with the Library of Parliament, and none of these treaties are on the website of the Department of Foreign Affairs, with the exception—and I also checked this as of today—of the North American free trade agreement, which is mentioned under the heading “Regional and Bilateral Agreements”.
