Where research infrastructure is concerned, small and medium-sized enterprises already receive considerable resources from the European Regional Development Fund, particularly in the area of encouraging innovation – where they receive innovation subsidies into the high tens of billions of euro.

Where a research organisation or research infrastructure is used to perform contract research or provide a research service to an undertaking, which typically specifies the terms and conditions of the contract, owns the results of the research activities and carries the risk of failure, no State aid will usually be passed to the undertaking if the research organisation or research infrastructure receive payment of an adequate remuneration for its services, particularly where one of the following conditions is fulfilled:

The implementation will follow a three-pronged approach: bottom-up where the exact content and partnership of projects are not known; targeted where the specific research infrastructures and/or communities addressed are well-defined; and named beneficiaries, for example where a contribution to operational costs is provided to (a consortium of) infrastructure operator(s).

In the case of indirect actions to support existing research infrastructures and, where applicable, new research infrastructures, the grant agreement may lay down specific provisions relating to confidentiality, publicity and access rights and commitments that might affect users of the infrastructure.
