I. whereas financial compensation is a fundamental economic support and it will not be possible to pay the medical costs of those victims requiring long-term medical care if the fund remains underfinanced; whereas Parliament regretted that the voluntary compensation arrangement through the Donor Trust Fund had not reached its target and noted that a mandatory mechanism would be more beneficial for the survivors and the families of the victims;

D. whereas no amount of money can compensate for the pain of those who have lost their loved ones; whereas financial compensation for the families of the dead and those injured and disabled as a result of the disaster is, however, essential in their struggle for economic survival; whereas two years after the Rana Plaza disaster, compensation is still a burning issue; whereas the amount determined to cover the total of all claims was set to be between USD 30 million and USD 40 million; whereas in February 2015 the total amount raised by these contributions was USD 21.5 million, leaving at least USD 8.5 million outstanding;

Whereas Article 12a of the basic Regulation introduces under certain conditions special financial compensation to be granted to producers' organizations by Member States; whereas the procedure for calculating monthly advances on the special financial compensation should be laid down;

Whereas, pursuant to Council Regulation (EEC) No 2601/69 of 18 December 1969 laying down special measures to encourage the processing of mandarins, satsumas, clementines and oranges (6), as last amended by Regulation (EEC) No 1123/89 (7), and Council Regulation (EEC) No 1035/77 of 17 May 1977 laying down special measures to encourage the marketing of products processed from lemons (8), as last amended by Regulation (EEC) No 1124/89 (9), financial compensation is granted to processors of such products subject to the payment to the producer of a minimum price; whereas it is difficult to establish the date of processing of each consignment; whereas, in order to ensure the uniform application of these arrangements, the operative event for entitlement to financial compensation should therefore occur on the first day of the marketing year for oranges, mandarins, satsumas and clementines and on 1 June and 1 December of each year for lemons; whereas, given the link between the financial compensation and the minimum price paid to the producer, the conversion rate to be applied to the latter must be the same as that applicable to the financial compensation;

Whereas Article 13 of Regulation (EEC) No 3796/81 provides for the payment of financial compensation to producers' organizations which intervene, on certain conditions, in respect of the products listed in Annex I (A) and (D) to that Regulation; whereas the amount of such financial compensation must be reduced by standard values in the case of products intended for purposes other than human consumption;

Whereas financial compensation is granted for certain quantities of Community oranges or mandarins with a view to ensuring that these products are available in the import markets of the Community ; whereas that rule would be meaningless if such products were exported later to third countries ; whereas, therefore, assurance of compliance with this prohibition must be obtained at the time that requests for the refund are submitted ; whereas, to that end, exporters should be obliged to furnish proof that the oranges and mandarins which they intend to export have not benefited from that compensation;
