IN-CONTEXT TRANSLATIONS

WHEREAS the Parliament of Canada recognizes that the safe and appropriate use of waterways is a matter of national importance; AND WHEREAS Parliament also recognizes that personal watercraft have given rise to considerable public concern because of the particular safety and environmental problems associated with their use; AND WHEREAS many communities consider that the Boating Restriction Regulations made under the Canada Shipping Act provide insufficient regulation of personal watercraft; AND WHEREAS further restrictions on their use are desirable; NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and the House of Commons of Canada, enacts as follows:

whereas the OSCE expressed serious reservations regarding the scope of the Hungarian laws (material and territorial scope), freedom of expression and the regulation of content, the appointment of one person to act as the national media and telecommunications authority, and compliance with the principles governing public-service broadcasting (4), indicating that the new legislation undermined media pluralism, abolished the political and financial independence of the public-service media and cemented the negative features for the free media in the long term, and that the Media Authority and Media Council were politically homogeneous (5) and exerted pervasive and centralised governmental and political control over all media; whereas further concerns included the disproportionate and extreme penalties imposed for debatable and undefined reasons, the lack of an automatic procedure for suspending penalties in the event of an appeal to the courts against a Media Authority ruling, the violation of the principle of the confidentiality of journalistic sources and the protection of family values,
considérant que l'OSCE a émis de sérieux doutes quant au champ d'application matériel et territorial des dispositions législatives hongroises, à la liberté d'expression et à la teneur de la législation, à la nomination d'une seule et même personne incarnant l'autorité nationale des médias et des télécommunications (4), à la diffusion des médias de service public, indiquant que la nouvelle législation compromet le pluralisme des médias, supprime l'indépendance politique et financière des médias de service public et grave dans le marbre des éléments négatifs pour la liberté des médias sur le long terme, et que l'Autorité des médias et le Conseil sont politiquement homogènes (5) et exercent un contrôle gouvernemental et politique centralisé et envahissant sur tous les médias; que d'autres inquiétudes sont soulevées, entre autres, par les sanctions disproportionnées et extrêmes infligées pour des raisons discutables et floues, l'absence d'une suspension automatique des sanctions en cas de recours en justice introduit contre une sanction prononcée par l'Autorité des médias, la violation du principe de confidentialité des sources journalistiques et la protection des valeurs de la famille,

whereas, under Article 57(2) of the Austrian Federal Constitutional Law, Members of the National Council (Nationalrat) may only be arrested on the grounds of a criminal offence with the consent of the National Council – except where they are caught in the act of committing a crime – and searches of the houses of members of the National Council likewise requires the consent of the National Council; whereas further to Article 57(3) of the Austrian Federal Constitutional Law, no official action on account of a punishable offence may be taken against members of the National Council without the National Council’s consent unless that offence is manifestly not connected with the political activity of the member in question and, under this provision, the authority concerned must seek a decision from the National Council as to whether such a connection exists, where this is so requested by the member in question or one third of the members of the appropriate standing committee;

(15) Whereas further action at the Community level may also be necessary to clarify the effect of the introduction of the euro on the application of existing provisions of Community law, in particular concerning netting, set-off and techniques of similar effect;

Whereas Council Directive 76/630/EEC of 20 July 1976 concerning surveys of pig production made by Member States(3) has been amended several times; and whereas, further amendments being necessary, the provisions thereof should, for reasons of clarity, be recast;

Whereas in addition to its general provisions Council Regulation (EEC) No 766/68 (3) of 18 June 1968 laying down general rules for granting export refunds on sugar, as last amended by Regulation (EEC) No 2488/69, (4) provides for the possibility of inviting tenders to determine the amount of the refund ; whereas detailed rules for the application of that Regulation were laid down by Commission Regulation (EEC) No 839/68 (5) of 28 June 1968 on detailed rules concerning export refunds on sugar, as last amended by Regulation (EEC) No 1965/69 (6) ; whereas Regulation (EEC) No 839/68 has already been amended several times and whereas further amendments are now necessary ; whereas in the interests of clarity, detailed rules for granting export refunds on sugar should therefore be regrouped in a new Regulation;
