A. whereas rights inherent to Union citizenship are incorporated in the Treaties and in the Charter of Fundamental Rights of the European Union; whereas the Treaty of Lisbon has strengthened the enforceability of fundamental rights with respect to the implementation of EU law by Member States at national level; whereas the entry into force of the Charter together with the Treaty of Lisbon generated great expectations among EU citizens that a new age of enhanced rights had begun in Europe; whereas Article 51 of the Charter states that the Member States and the institutions, bodies and agencies of the EU must respect these rights and observe the principles and promote the application thereof in accordance with their respective powers; whereas that article is regarded by the Commission as a limitation on the exercise of its role as guardian of the Treaties; whereas the accession of the EU to the ECHR will strengthen its commitment to the protection of fundamental rights;

J. whereas the Treaty on Conventional Armed Forces in Europe (CFE), signed by 16 NATO members and 6 Warsaw Pact countries in 1990 and amended in 1999, is the most significant disarmament agreement in history where conventional weapons are concerned; whereas this Treaty has been ratified by Russia, Belarus, and Ukraine, but has been shelved by NATO; whereas Russia has since suspended the Treaty,

whereas the conditions for the admission of the applicant country and the modifications which its accession entails are set out in the draft Treaty concerning the Accession of the Republic of Croatia to the European Union, and whereas Parliament should be consulted on any substantial modifications to the draft Treaty,

R. whereas one of the new fundamental objectives laid down in Article 3(5) of the Treaty on European Union (corresponding to the current Article 2(5) as it would be amended by Article 1(4) of the Treaty of Lisbon) is that in its relations with the rest of the world the Union must contribute to the protection of its citizens; whereas the Treaty on European Union also specifies, in Article 3(2) (corresponding to the current Article 2(2) as it would likewise be amended by Article 1(4) of the Lisbon Treaty), that the Union offers its citizens ‘an area of freedom, security and justice’ without internal borders, ‘in which the free movement of persons is assured in conjunction with appropriate measures’ with respect to (inter alia) external border controls,

C. whereas Article 85 of the EC Treaty requires the Commission to ensure application of the principles laid down in Articles 81 and 82 of the Treaty concerning competition law; whereas the Treaty provides for other legal bases that can contribute to the effectiveness of those principles, such as Article 65, which enables the European Union to eliminate obstacles to the good functioning of proceedings in civil matters having cross-border implications; and whereas as the Court of Justice considers that, in the absence of Community rules governing the right of victims to claim damages before the national courts, it is for the domestic legal system of each Member State to designate the courts and tribunals having jurisdiction and to lay down the detailed procedural rules governing actions for safeguarding rights which individuals derive directly from Community law, provided that such rules are not less favourable than those governing similar domestic actions (principle of equivalence), and provided that they do not render practically impossible or excessively difficult the exercise of rights conferred by Community law (principle of effectiveness),

WHEREAS the provisions of Title IV of the Treaty establishing the European Community and the acts adopted on the basis of that Title do not apply to the Kingdom of Denmark pursuant to the Protocol on the position of Denmark annexed by the Treaty of Amsterdam to the Treaty on European Union and to the Treaty establishing the European Community, but it should be made possible for the Swiss Confederation and Denmark to apply the substantive provisions of this Agreement in their relations with each other.
CONSIDÉRANT que les dispositions du titre IV du traité instituant la Communauté européenne et des actes adoptés sur la base dudit titre ne s'appliquent pas au Royaume de Danemark en vertu du protocole sur la position du Danemark annexé par le traité d'Amsterdam au traité sur l'Union européenne et au traité instituant la Communauté européenne, mais qu'il convient de créer la possibilité pour la Confédération suisse et le Danemark d'appliquer, dans leurs relations mutuelles, les dispositions de fond du présent accord.

WHEREAS the Treaty concerning the accession of the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic to the European Union (hereinafter referred to as ‘Treaty of Accession’) was signed in Athens on 16 April 2003.
CONSIDÉRANT que le traité concernant l’adhésion de la République tchèque, de la République d’Estonie, de la République de Chypre, de la République de Lettonie, de la République de Lituanie, de la République de Hongrie, de la République de Malte, de la République de Pologne, de la République de Slovénie et de la République slovaque à l’Union européenne (ci-après dénommé «traité d’adhésion») a été signé à Athènes le 16 avril 2003.

Whereas the United Kingdom of Great Britain and Northern Ireland has a special position in respect of matters covered by Title IV of Part Three of the Treaty establishing the European Community, as recognised in the Protocol on the position of the United Kingdom and Ireland and in the Protocol on the application of certain aspects of Article 14 of the Treaty establishing the European Community to the United Kingdom and to Ireland, annexed by the Treaty of Amsterdam to the Treaty on European Union and to the Treaty establishing the European Community.
