All the basic elements pertaining to the payment of Union support to farmers should be included in this Regulation, which should also fix the conditions of access to payments which are inextricably linked to those basic elements.

2. For each Member State and for each calendar year, the estimated product of the reduction of payments referred to in Article 11 (which is reflected by the difference between the national ceiling set out in Annex II, to which is added the amount available in accordance with Article 58, and the net ceiling set out in Annex III) shall be made available as Union support for measures under rural development programming financed under the European Agricultural Fund for Rural Development (EAFRD) as specified in Regulation (EU) No 1305/2013.
2. In its Conclusions of 8-9 December 2008, the Council of the European Union supported the first draft for an international Code of Conduct, in which states would participate on a voluntary basis, and which included transparency and confidence-building measures, as a basis for consultations with key third states that have activities in outer space or have interests in outer-space activities, with the aim of securing a text that is acceptable to the greatest number of states.
Dans ses conclusions des 8 et 9 décembre 2008, le Conseil de l'Union européenne a apporté son soutien au premier projet de code de conduite international, auquel les États participeraient sur une base volontaire, et comportant des mesures de transparence et de confiance, et qui devait servir de base aux consultations avec des États tiers essentiels ayant des activités spatiales ou ayant des intérêts dans ces activités, l'objectif étant de parvenir à un texte qui soit acceptable par le plus grand nombre d'États.

5. Areas in countries other than Member States or other cross-border cooperation participating countries which adjoin eligible areas as defined in points (a) and (b) of Article 8(1) or which face a common sea basin where a joint operational programme is being established may be covered by a joint operational programme and may benefit from Union support under this Regulation in accordance with the conditions set out in the programming document referred to in Article 9(1).

Moreover, with a view to ensuring consistency with the rural development measures eligible for Union support and in order to simplify procedures, payments made by the Member States, intended to provide additional national financing for rural development operations for which Union support is granted and which fall within the scope of Article 42 TFEU, should be included in the rural development programme for assessment and approval in accordance with the provisions of this Regulation.

Nevertheless, given the specific characteristics of the agricultural sector, those TFEU provisions should not apply to rural development measures concerning operations falling within the scope of Article 42 TFEU, that are carried out under and in conformity with this Regulation or to payments made by Member States, intended to provide additional national financing for rural development operations for which Union support is granted and which fall within the scope of Article 42 TFEU.
Néanmoins, compte tenu des caractéristiques spécifiques du secteur agricole, ces dispositions du traité sur le fonctionnement de l'Union européenne ne devraient pas s'appliquer aux mesures de développement rural qui concernent des opérations relevant du champ d'application de l'article 42 du traité sur le fonctionnement de l'Union européenne, réalisées au titre du présent règlement et en conformité avec celui-ci, ni aux paiements effectués par les États membres en vue de fournir un financement national complémentaire pour les opérations de développement rural qui bénéficient d'un soutien de l'Union et qui relèvent du champ d'application de l'article 42 du traité sur le fonctionnement de l'Union européenne.

Payments made by Member States intended to provide additional national financing for rural development operations for which Union support is granted and which fall outside the scope of Article 42 TFEU should be notified to the Commission pursuant to Article 108(3) TFEU, unless they fall under a regulation, adopted pursuant to Council Regulation 994/98 , and Member States should be precluded from putting them into effect until that notification procedure has resulted in a final approval by the Commission.
