In relation to the carriage performed by the actual carrier, any servant or agent of that carrier or of the contracting carrier shall, if they prove that they acted within the scope of their employment, be entitled to avail themselves of the conditions and limits of liability which are applicable under this Convention to the carrier whose servant or agent they are, unless it is proved that they acted in a manner that prevents the limits of liability from being invoked in accordance with this Convention.

2. With the agreement of the High Representative and of the national diplomatic service concerned, the contracts of temporary staff from national diplomatic services of the Member States who were engaged, or whose contract was amended, after 30 November 2009 and who occupy a post in an organisational entity which is transferred from the General Secretariat of the Council or the Commission to the EEAS pursuant to Council Decision 2010/427/EU shall be transformed, without a new selection procedure, into contracts under Article 2(e) of the Conditions of Employment of Other Servants.
2. Avec l'accord du haut représentant et du service diplomatique national concerné, les contrats des agents temporaires des services diplomatiques nationaux des États membres qui ont été engagés, ou dont le contrat a été modifié, après le 30 novembre 2009 et qui occupent un poste dans une entité organisationnelle qui est transférée du Secrétariat général du Conseil ou de la Commission au SEAE conformément à la décision du Conseil n° 2010/427/UE sont transformés, sans nouvelle procédure de sélection, en contrats conformément à l'article 2, point e), du régime applicable aux autres agents.

Dragoş Florin David (PPE-DE), in writing. – (RO) I voted in favour of the proposal for a Council regulation amending the Conditions of employment of other servants of the European Communities because local assistant contracts are to be administered by paying agents, whose role will be to ensure the effective management of the parliamentary assistance allowance allocated to each Member, for which they will be held responsible, thereby putting an end to the uncertainties and ambiguities obtaining under the current arrangements, which have come in for criticism.
J’ai voté en faveur de la proposition de règlement du Conseil modifiant le régime applicable aux autres agents des Communautés européennes parce qu’elle institue, pour la gestion des contrats des assistants locaux, la figure du tiers payant, chargé d’assurer la bonne gestion de l’indemnité d’assistance parlementaire attribuée à chaque député en en assumant la responsabilité, ce qui met fin aux incertitudes et aux ambiguïtés qui caractérisent le régime actuel, cible de critiques diverses.
