La présente directive a pour objet d’assurer la protection des travailleurs intérimaires et d’améliorer la qualité du travail intérimaire en assurant le respect du principe de l’égalité de traitement, tel qu’il est énoncé à l’article 5, à l’égard des travailleurs intérimaires et en reconnaissant les entreprises de travail intérimaire comme des employeurs, tout en tenant compte de la nécessité d’établir un cadre approprié d’utilisation du travail intérimaire en vue de contribuer efficacement à la création d’emplois et au développement de formes souples de travail.

However, as may be deduced from point 21 of the guidelines, in the case of the employment of disadvantaged persons, the requirement of long-term employment and net job creation is not essential if the temporary recruitment - as in the case of GAV - is voluntarily terminated; the main reason for the provision in point 13 is to ensure that a firm regularly employing disadvantaged persons on the basis of temporary work contracts does not then dismiss them when the temporary work contract has expired, only to recruit further disadvantaged persons, for a limited period once again, with the help of further aid.
Toutefois, comme il ressort du point 21 des lignes directrices, en cas de recrutement de personnes défavorisées, il n'y a pas lieu d'exiger qu'il y ait emploi permanent ou création nette d'emploi, pour autant que l'emploi à temps partiel le soit à la suite d'un départ volontaire - comme c'est le cas chez GAV; le principal objectif des dispositions du point 13 est d'éviter qu'une entreprise ne recrute régulièrement des personnes défavorisées sur la base de contrats à durée déterminée pour les licencier à la fin du contrat et recruter ensuite de nouvelles personnes défavorisées, grâce à de nouvelles aides, pour une durée déterminée.
