In its judgment, after finding that the Directive was concerned with the approximation of national provisions relating to the advertising and sponsorship of tobacco products, which were to a large extent inspired by public health policy objectives (judgment, paragraph 76), the Court of Justice made it clear that, whereas Article 152(4) (ex Article 129) of the EC Treaty precludes harmonisation designed to protect human health, measures adopted on the basis of the other provisions of the Treaty may have an impact on protection of human health, since Article 152(1) provides that health requirements are to form a constituent part of the Community's other policies.
