(8) As regards the 45 % tax credit in force from 1 January to 31 December 1995, the sixth additional provision of Provincial Law No 22/1994 of 20 December 1994 reads as follows: "Investments in new tangible fixed assets carried out between 1 January 1995 and 31 December 1995 and exceeding ESP 2500 million shall, by decision of the Álava Provincial Council, qualify for a tax credit equivalent to 45 % of the amount of the investment, as determined by the Álava Provincial Council, to be offset against the amount of personal tax liability.
(8) En ce qui concerne le crédit d'impôt de 45 % en vigueur du 1er janvier 1995 au 31 décembre 1995, le libellé de la sixième disposition additionnelle de la Loi provinciale n° 22/1994 du 20 décembre 1994 précitée est le suivant: "Les investissements en actifs fixes matériels neufs, effectués entre le 1er janvier 1995 et le 31 décembre 1995, d'un montant excédant 2500 millions d'ESP, sur accord de la Diputación Foral de Álava, bénéficieront d'un crédit d'impôt de 45 % du montant déterminé par cette dernière, applicable au montant final de l'impôt à payer.

6. The application of the tax credit to which this general provision refers shall be notified by the taxpayer to the Álava Provincial Council, using the form approved for that purpose by the Provincial Commission for Tax, Finance and Budgets.
(6) L'application du crédit d'impôt visé par la présente disposition générale est subordonnée à sa communication par le contribuable à la Diputación Foral de Álava selon le modèle établi à cet effet par le Diputado Foral de Hacienda, Finanzas y Presupuesto.

In its final decision the Commission takes the view that the tax concessions granted to Ramondín (tax credit) and Ramondín Cápsulas (deduction in taxable amount) must be classified as state aid because they are selective in nature. This finding stems not only from the discretionary power enjoyed by the Álava Provincial Government to grant tax credits but also from the fact that those tax concessions are available solely to certain types of investor (new firms investing EUR 500 000 (ESP 80 million) and creating at least 10 jobs in the case of deductions in the taxable amount, or large industrial investors with a sound financial base in the case of tax credits).
