A. whereas the Central District Court of Buda, Budapest, has requested the waiver of immunity of Ágnes Hankiss, a Member of the Parliament, in order to conduct renewed criminal proceedings against Ágnes Hankiss as ordered by the judgment of the Supreme Court of the Republic of Hungary,
A. overwegende dat het kantongerecht van Boeda, Boedapest, om opheffing van de immuniteit van Ágnes Hankiss, een lid van het Europees Parlement, heeft verzocht, teneinde tegen Ágnes Hankiss een nieuw strafproces aan te spannen, zoals in het vonnis van het hooggerechtshof van de republiek Hongarije was bevolen,

B. whereas the waiver of the immunity of Ágnes Hankiss relates to an alleged offence of defamation under Section 181 of the Hungarian Criminal Code as a result of a statement made during the programme ‘Péntek 8 mondatvadász ’ on 23 January 2004,
B. overwegende dat om opheffing van de immuniteit van Ágnes Hankiss verzocht is omdat zij zich tijdens het televisieprogramma „Péntek 8 mondatvadász” van 23 januari 2004 schuldig zou hebben gemaakt aan belediging ex artikel 181 van het Hongaarse wetboek van strafrecht,

C. whereas Ágnes Hankiss was accused by a private plaintiff in an accusation dated 18 February 2004 and submitted to the Central District Court of Buda on 23 February 2004; whereas the Central District Court of Buda gave its judgment on 28 June 2005, which was then appealed against in the Budapest Municipal Court and annulled by that Court on 3 February 2006,
C. overwegende dat een particulier op 18 februari 2004 een schriftelijke aanklacht tegen Ágnes Hankiss heeft ingediend die op 23 februari 2004 bij het kantongerecht van Boeda is binnengekomen; overwegende dat het kantongerecht van Boeda op 28 juni 2005 uitspraak in deze zaak heeft gedaan waartegen beroep is aangetekend bij de rechtbank van Boedapest die deze uitspraak op 3 februari 2006 nietig verklaarde,

– having regard to the request for waiver of the immunity of Ágnes Hankiss, forwarded by the Central District Court of Buda on 6 July 2010 and announced in plenary sitting on 6 September 2010,
– gezien het aan het Parlement voorgelegde verzoek om opheffing van de immuniteit van Ágnes Hankiss, dat op 6 juli 2010 werd ingediend door het kantongerecht van Boeda, en van de ontvangst waarvan op 6 september 2010 ter plenaire vergadering kennis werd gegeven,

– having heard Ágnes Hankiss on 11 April 2011 in accordance with Rule 7(3) of its Rules of Procedure,
