Until 31 December 2011, the Spanish authorities shall be authorised to apply a tax known as "Arbitrio sobre las Importaciones y Entregas de Mercancías en las islas Canarias (AIEM)", the rates and exemptions for which are set in accordance with Articles 2 and 3, to products imported into and obtained in the Canary Islands, as listed in Annex 1.

The argument regarding strict conditions for the application of the AIEM tax was confirmed by the judgment of 19 February 1998 by the Court of Justice of the European Communities on the system of dock dues applicable to the French overseas departments, which is very similar to the APIM and AIEM taxes in the Canary Isles.

The Commission considered the Spanish request concerning the AIEM in the light of Article 299(2) of the Treaty and, after identifying a series of handicaps affecting the Canarian economy, concluded that the AIEM would be a useful means of promoting economic and social development in the Canary Islands.
