Recalls that, under Articles 1(c) and 15(1) of Regulation (EC) No 1049/2001, the institutions are required to ‘promote good administrative practises on access to documents’ and to ‘develop good administrative practices in order to facilitate the exercise of the rights guaranteed by (the) Regulation’; stresses that transparency is closely connected with the right to good administration, as referred to in Article 298 TFEU and Article 41 of the Charter of Fundamental Rights, and reiterates its call for the adoption of a regulation on the administrative procedure of the EU’s own administration

whereas the right of access to documents is a fundamental right, protected by the Charter of Fundamental Rights and the Treaties and implemented by Regulation (EC) No 1049/2001, with the aim, in particular, of ensuring that this right can be exercised as easily as possible, and of promoting good administrative practices regarding access to documents by ensuring democratic scrutiny of the activities of the institutions and ensuring that they comply with the rules enshrined in the Treaties.

Regrets that it is still difficult for citizens to gain access to information held by EU institutions, the reason being that there is no common approach among the institutions geared to facilitate access to documents for citizens and based on complete transparency, communication and direct democracy; urges the EU institutions, bodies, offices and agencies to develop further a more proactive approach on transparency by proactively disclosing as many of their documents as possible, in the most simple, user-friendly and accessible way, by having documents translated upon request into other EU official languages, and by establishing proper, simple and inexpensive information access arrangements, including by digital and electronic means, allowing for the needs of people with disabilities; considers, in particular, that the accessibility of information should be improved on by means of easy-to-use interfaces and search systems; calls for the development of a common access point to the portals of the three institutions, building on the pilot project for the online platform for the proactive publication of EU institutions documents, and for harmonising search portals between departments of the same institution (including Directorates-General in the Commission); calls, as well, on the institutions to continue and strengthen the work of expanding knowledge of EU legislation and policies; believes that, to that end, the EU should make full use of the potential offered by new technologies (social networks, smartphone applications, etc.) in order to ensure complete and easy access to information.

H. whereas the EU legislation on access to documents is still not being properly applied by the Union’s administration; whereas the exceptions of Regulation (EC) No 1049/2001 are being applied routinely rather than exceptionally by the administration;
H. overwegende dat de administratie van de Unie de EU-wetgeving inzake de toegang tot documenten nog altijd niet naar behoren naleeft; overwegende dat de administratie de in Verordening (EG) nr. 1049/2001 opgenomen uitzonderingen stelselmatig en niet bij wijze van uitzondering toepast;

8. Calls on the EU institutions, bodies, offices and agencies to develop further a more proactive approach on transparency by making publicly accessible on their internet websites as many categories of documents as possible, including internal administrative documents, and by including these in their public registries; considers that this approach helps ensure effective transparency as well as prevent unnecessary litigation that may cause unnecessary costs and burdens for both the institutions and the citizens;
8. vraagt de instellingen, organen, bureaus en agentschappen van de EU een meer proactieve aanpak van transparantie te ontwikkelen door op hun websites zo veel mogelijk categorieën van documenten voor het publiek toegankelijk te maken, waaronder interne administratieve documenten, en door deze documenten op te nemen in hun openbare registers; is van mening dat deze aanpak bijdraagt tot een doeltreffende transparantie en tot het voorkomen van onnodige gerechtelijke procedures, die onnodige kosten en lasten voor zowel de instellingen als de burgers met zich meebrengen;

8. Believes that accessing information relating to the EU institutions still remains an obstacle-strewn path for ordinary citizens due to the lack of an effective citizen-oriented inter-institutional policy of transparency and communication; considers that regardless of the point of access, EU citizens should be able to track a given legislative or administrative procedure and access all the documents relating to it ; as called for as early as in 2001, an inter-institutional road-map should be defined to improve, simplify and complete the EU institutions' registers and web pages and make them interoperable; EU institutions that aim to lead the development of e-government techniques should be able and willing to create a true inter-institutional search engine which would make access to documents and information more user-friendly for the public;
8. is van mening dat de gewone burger bij het zoeken naar informatie over de instellingen van de EU vanwege het ontbreken van een effectief op de burgers gericht interinstitutioneel transparantie- en communicatiebeleid nog steeds veel obstakels tegenkomt; is van mening dat de burgers van de EU, ongeacht het punt van toegang, de mogelijkheid moeten hebben om een bepaalde wetgevende of administratieve procedure te volgen en toegang moeten hebben tot alle met die procedure samenhangende documenten ; zoals reeds in 2001 werd gevraagd, dient een interinstitutionele routekaart te worden opgesteld om de registers en homepages van de EU-instellingen te verbeteren, vereenvoudigen en completeren en ze bovendien interoperabel te maken; EU-instellingen die het voortouw willen nemen bij de ontwikkeling van elektronische overheidsdiensten moeten een heuse interinstitutionele zoekmachine kunnen en willen ontwerpen waarmee de toegang tot documenten en informatie gebruikersvriendelijker wordt;

7. Considers that retrieving documents and information would be easier if the documents themselves were tabled, registered and re-used by other legislative institutions in compliance with common standards (for instance for references to different versions of the same document, its amendments, annexes and corrigenda) by using open-source word processors, effective multilingualism and technologies that also allow persons with disabilities to gain access to information and documents, as suggested by the Commission to the Member States in its Communication on interoperability solutions for European public administrations (ISA) (COM (2008)0583) and as provided for in Directive 2003/98/EC of the European Parliament and of the Council of 17 November 2003 on the re-use of public sector information );
7. is van oordeel dat het opvragen van documenten en informatie gemakkelijker zou gaan als de documenten overeenkomstig gemeenschappelijke normen (voor bijvoorbeeld verwijzingen naar verschillende versies van hetzelfde document, amendementen, bijlagen en rectificaties) zouden worden ingediend, geregistreerd en door andere wetgevende instellingen zouden worden hergebruikt met behulp van opensourcetekstverwerkers, effectieve meertaligheid en technologieën die toegang tot informatie en documenten mogelijk maken voor mensen met een handicap, zoals door de Commissie aan de lidstaten voorgesteld in haar mededeling inzake interoperabiliteitsoplossingen voor Europese overheidsdiensten (ISA) (COM(2008)0583) en zoals voorzien in Richtlijn 2003/98/EG van het Europees Parlement en de Raad van 17 november 2003 inzake het hergebruik van overheidsinformatie ;

6. Without prejudice to specific rights of access for interested parties established by EC law, documents forming part of the administrative file of an investigation or of proceedings concerning an act of individual scope shall not be accessible to the public until the investigation has been closed or the act has become definitive.
6. Onverminderd specifieke toegangsrechten voor belanghebbenden op grond van het Gemeenschapsrecht, zijn documenten die deel uitmaken van een dossier over een onderzoek of over een procedure betreffende een besluit van individuele strekking niet toegankelijk voor het publiek tot het onderzoek is afgesloten of het besluit definitief is geworden.
