In view of Council Regulation (EC) No 1407/2002 of 23 July 2002 on State aid to the coal industry , this Regulation should not apply to aid favouring activities in the coal sector with the exception of training aid, research and development and innovation aid and environmental aid.
Gelet op Verordening (EG) nr. 1407/2002 van de Raad van 23 juli 2002 betreffende staatssteun voor de kolenindustrie dient deze verordening niet op steun ten behoeve van activiteiten in de kolenindustrie van toepassing te zijn, met uitzondering van opleidingssteun, steun voor onderzoek, ontwikkeling en innovatie, en milieusteun.

With regard to the notification of aid which a Member State intends to grant to the coal industry, in accordance with Article 8 of Decision No 3632/93/ECSC, Spain notified the Commission on 31 March 1998 of the 1998-2002 modernisation, rationalisation, restructuring and activity-reduction plan based on the 1998-2005 plan for the coal industry and alternative development of coalmining areas, which was approved by the Commission in Decision 98/637/ECSC of 3 June 1998 (11).
Wat de kennisgeving overeenkomstig artikel 8 van Beschikking nr. 3632/93/EGKS betreft van de steun die de lidstaten voornemens zijn aan de kolenindustrie te verlenen, stelde Spanje de Commissie op 31 maart 1998 op de hoogte van het plan voor modernisering, rationalisering, herstructurering en buitenbedrijfstelling voor de periode 1998-2002 afgeleid van het plan 1998-2005 van de kolenmijnbouw en de alternatieve ontwikkeling van de regio's, waaraan de Commissie bij haar Beschikking nr. 98/637/EGKS van 3 juni 1998 (11) haar goedkeuring hechtte.

(37) The aid of EUR 268196000 which Spain proposes to grant is intended to cover, with the exception of the costs for the payment of social welfare benefits borne by the State as a special contribution pursuant to Article 56 of the Treaty, compensation paid to workers in Spanish coal undertakings who have lost their jobs or have had or will have to take early retirement under the modernisation, rationalisation, restructuring and activity-reduction plan for the Spanish coal industry.
(37) De steun ten bedrage van 268196000 EUR die Spanje voornemens is toe te kennen, is, met uitzondering van de kosten voor de sociale uitkeringen die de staat krachtens artikel 56 van het Verdrag als bijzondere bijdrage moet leveren, bestemd voor de financiering van de schadeloosstellingen aan de werknemers die met vervroegd pensioen zijn gegaan of zullen moeten gaan of die hun baan hebben verloren als gevolg van de toepassing van het plan voor modernisering, rationalisering en herstructurering van de Spaanse kolenindustrie en voor buitenbedrijfstelling in deze industrie.

(35) The inclusion of this measure in the modernisation, rationalisation, restructuring and activity-reduction plan notified by Spain, and the reduction in the aid and quantities envisaged for 2002, are in line with the objectives of the first and second indents of Article 2(1) of Decision No 3632/93/ECSC, and in particular the objective of solving the social and regional problems created by developments in the coal industry.
(35) Het opnemen van deze maatregel in het door Spanje aangemelde plan voor modernisering, rationalisering, herstructurering en buitenbedrijfstelling en de degressie van de voor 2002 geplande steunbedragen zijn in overeenstemming met de in artikel 2, lid 1, eerste en tweede streepje van Beschikking nr. 3632/93/EGKS omschreven doelstellingen, met name de oplossing van de sociale en regionale problemen in verband met de ontwikkelingen in de kolenindustrie.

In addition, the increasing overlap between services and industry is changing the contours of industrial activity as such, and accentuating the apparent reduction in the importance of manufacturing industry.
Bovendien verandert de toenemende vervlechting van diensten en industrie het aanzien van de eigenlijke industriële activiteit, waardoor de schijnbare achteruitgang van de verwerkende sector nog wordt geaccentueerd.

(10) The plan for the modernisation, rationalisation, restructuring and reduction of activity in the coal industry for the period 1998 to 2002 is based on two fundamental objectives, namely optimum use of the lower financial resources and reduction of production and productions costs.
(10) Het plan voor modernisering, rationalisering, herstructurering en buitenbedrijfstelling voor de periode 1998-2002 gaat met name uit van twee fundamentele doelstellingen: enerzijds optimaal gebruik van beperkte financiële middelen en anderzijds inkrimping van de productie en de productiekosten.

These aid amounts, DEM 3847 million for 2000 and DEM 3433 million for 2001, are moreover in line with the provisions of the plan for modernisation, rationalisation, restructuring and reduction of activity in the coal industry, and in particular the new guidelines for this plan as set out in recitals 14 to 31.
