As competent authorities in Member States currently use different formats of advanced electronic signatures to sign their documents electronically, the receiving Member States that have to process these documents may face technical difficulties due to the variety of signature formats used.

Where it is justified for Member States to ask for advanced electronic signatures, as defined in point 2 of Article 2 of Directive 1999/93/EC of the European Parliament and of the Council of 13 December 1999 on a Community framework for electronic signatures , for the completion of procedures referred to in paragraph 1 of this Article, Member States shall accept electronic signatures in compliance with Commission Decision 2009/767/EC of 16 October 2009 setting out measures facilitating the use of procedures by electronic means through the points of single contact under Directive 2006/123/EC of the European Parliament and of the Council on services in the internal market and provide for technical means to process documents with advanced electronic signature in formats defined by Commission Decision 2011/130/EU of 25 February 2011 establishing minimum requirements for the cross-border processing of documents signed electronically by competent authorities under Directive 2006/123/EC of the European Parliament and of the Council on services in the internal market .
3. Wanneer het gerechtvaardigd is dat de lidstaten voor de afhandeling van de in lid 1 van dit artikel bedoelde procedures geavanceerde elektronische handtekeningen als gedefinieerd in artikel 2, punt 2 van Richtlijn 1999/93/EG van het Europees Parlement en de Raad van 13 december 1999 betreffende een gemeenschappelijk kader voor elektronische handtekeningen* verlangen, aanvaarden de lidstaten elektronische handtekeningen overeenkomstig Beschikking 2009/767/EG van de Commissie van 16 oktober 2009 inzake maatregelen voor een gemakkelijker gebruik van elektronische procedures via het één-loket in het kader van Richtlijn 2006/123/EG van het Europees Parlement en de Raad betreffende diensten op de interne markt** en voorzien zij in technologische maatregelen om de bij Besluit 2011/130/EU van de Commissie van 25 februari 2011 tot vaststelling van minimumvoorschriften voor de grensoverschrijdende verwerking van documenten die door de bevoegde autoriteiten elektronisch zijn ondertekend krachtens Richtlijn 2006/123/EG van het Europees Parlement en de Raad betreffende diensten op de interne markt*** vastgestelde formats voor geavanceerde e-handtekeningen te verwerken.
