In line with the capital structure of entities affiliated to a central body, for the purposes of this Regulation, the Board, or, where relevant, the national resolution authorities, should not be obliged to draw up separate resolution plans solely on the grounds that the central body to which those entities are affiliated is under direct supervision of the ECB.

Member States may allow the central body and all credit institutions permanently affiliated to the central body as referred to in Article 10(1) of Regulation (EU) No 575/2013 to be subject as a whole to the risk weight determined for the central body and its affiliated institutions on a consolidated basis.

(28) Gezien de kapitaalstructuur instellingen die bij een centraal orgaan zijn aangesloten, dienen deze instellingen voor de toepassing van deze richtlijn niet verplicht te zijn elk aparte herstel- of afwikkelingsplannen op te stellen louter op grond van het feit het centrale orgaan waarbij zij zijn aangesloten, onder rechtstreeks toezicht van de Europese Centrale Bank staat.

Member States should be able to decide that, for the purpose of this Directive, the central body and all credit institutions affiliated to that central body are treated as a single credit institution.
De lidstaten moeten kunnen besluiten dat, voor de toepassing van onderhavige richtlijn, het centrale orgaan en alle kredietinstellingen die bij dat centrale orgaan zijn aangesloten als één enkele kredietinstelling worden behandeld.

5. Without prejudice of the provisions of Articles 7a and 29, on receiving a proposal to waive the obligation of drafting resolution plans pursuant to paragraph 2, or when acting on its own initiative, the Board shall, pursuant to paragraph 3, waive the application of the obligation of drafting resolution plans to institutions affiliated to a central body and wholly or partially exempted from prudential requirements in national law in accordance with Article 10 of Regulation (EU) No 575/2013 .
5. Onverminderd de bepalingen van de artikelen 7 bis en 29 verleent de afwikkelingsraad, na ontvangst van een voorstel om overeenkomstig lid 2 ontheffing te verlenen van de verplichting om afwikkelingsplannen op te stellen, of handelend op eigen initiatief, overeenkomstig lid 3 aan instellingen die bij een centraal orgaan zijn aangesloten en die overeenkomstig artikel 10 van Verordening (EU) nr. 575/2013 geheel of gedeeltelijk van prudentiële vereisten in het nationale recht zijn vrijgesteld, ontheffing van de verplichting om herstelplannen op te stellen.

Such cases comprise institutions affiliated to a central body and wholly or partially exempt from prudential requirements in national law in accordance with Article 21 of Directive 2013/36/EU and institutions which belong to an institutional protection scheme in accordance with Article 113(7) of Regulation (EU) No 575/2013.
Daarbij gaat het onder meer om instellingen die bij een centraal orgaan zijn aangesloten en die overeenkomstig artikel 21 van Richtlijn 2013/36/EU geheel of gedeeltelijk zijn vrijgesteld van prudentiële regels in het nationale recht, en instellingen die overeenkomstig artikel 113, lid 7, van Verordening (EU) nr. 575/2013 tot een institutioneel protectiestelsel behoren.

6. A credit institution which, as defined in the first subparagraph of paragraph 5, is affiliated to a central body in the same Member State may also be exempted from the provisions of Article 5, and also Articles 40 to 51, and 65 provided that, without prejudice to the application of those provisions to the central body, the whole as constituted by the central body together with its affiliated institutions is subject to the abovementioned provisions a consolidated basis.
6. Kredietinstellingen als gedefinieerd in lid 5, eerste alinea, die in eenzelfde lidstaat zijn aangesloten bij een in die lidstaat gevestigd centraal orgaan kunnen eveneens van toepassing van artikel 5 en van de artikelen 40 tot en met 51 en 65 worden vrijgesteld, mits, onverminderd de toepassing van deze richtlijn op het centraal orgaan, het geheel dat door het centraal orgaan en de aangesloten instellingen wordt gevormd, op geconsolideerde basis aan genoemde voorschriften is onderworpen.
