TRADUCTIONS EN CONTEXTE

This Regulation constitutes a special agreement within the meaning of Article 142 of the EPC, a regional patent treaty within the meaning of Article 45(1) of the Patent Cooperation Treaty of 19 June 1970 and a special agreement within the meaning of Article 19 of the Convention for the Protection of Industrial Property, signed in Paris on 20 March 1883 and last revised on 14 July 1967.

On 9 April the ‘Presidium of the Parliament of Crimea’ adopted a decision No 1991-6/14 ‘On the amendments to the Resolution of the State Council of the Republic of Crimea’ of 26 March 26 2014 No. 1836-6/14 ‘On nationalization of the property of enterprises, institutions and organizations of agro-industrial complex, located in the territory of the Republic of Crimea’ declaring the appropriation of assets belonging to the ‘Azovsky likerovodochny zavod’ on behalf of the ‘Republic of Crimea’.
Het „Presidium van het Parlement van de Krim” heeft op 9 april Besluit nr. 1991-6/14 aangenomen „Over de wijzigingen van Resolutie nr. 1836-6/14 van de Staatsraad van de Republiek van de Krim” van 26 maart 2014„Over de nationalisatie van de eigendom van bedrijven, instellingen en organisaties van het agroindustriële complex op het grondgebied van de Republiek van de Krim”, waarin wordt verklaard dat de activa in het bezit van het bedrijf „Azovsky likerovodochny zavod” namens de „Republiek van de Krim” worden onteigend.

2. Welcomes the leadership of African Union and its initiatives towards enhanced integration and improved sustainable development of the African continent; recognizes also the important dimension of regional integration for growth and development and stresses in particular the commitment of the Tripoli Declaration to make the African Peace and Security Architecture fully operational in close collaboration with the regional organizations;

Within the scope of this Agreement, each Party undertakes to ensure that natural and legal persons of the other Party have access free of discrimination in relation to its own nationals to the competent courts and administrative organs of the Parties to defend their individual rights and their property rights, including those concerning intellectual, industrial and commercial property.

The agreement aims to ensure that adequate rules on the protection of intellectual property are applied in all member countries, on the basis of the basic obligations laid down by the World Intellectual Property Organization (WIPO) in the various conventions on intellectual property rights, particularly the Paris Convention for the Protection of Industrial Property.
De overeenkomst strekt ertoe te waarborgen dat in alle lidstaten toereikende maatregelen worden toegepast op basis van de fundamentele verplichtingen zoals die door de Wereldorganisatie voor de intellectuele eigendom (WIPO) zijn opgenomen in de diverse verdragen over intellectuele-eigendomsrechten, in het bijzonder het Verdrag van Parijs tot bescherming van de industriële eigendom.

6. Emphasises the important role which the EU should play, in international institutions such as the World Trade Organization, the International Monetary Fund and the World Bank, defending vigorously the right of African States to protect national and regional markets on the African continent against imports threatening the survival of local producers of essential agricultural products;

28. Regrets the fact that in the above-mentioned Communication entitled "Advancing African Agriculture" the market in biofuels has been lumped together with other niche markets, since the expansion of the emerging biofuels industry could also have a detrimental effect on foods supplies, given that the growing of biomass could take land, water and other resources away from agricultural production; agrees, however, that it is important for markets in organic products and for fair, mutually beneficial trade to be supported;

I believe that allocating EUR 15 million of EU funds for restructuring the wines and spirits sector must take account of the breach of industrial property rights arising from the illegal use of traditional European wine names, such as those associated with Port wine, by South African producers.
Er wordt vijftien miljoen euro vrijgemaakt voor de herstructurering van de wijn- en gedistilleerde drankensector. We mogen in dit verband niet vergeten dat Zuid-Afrikaanse producenten misbruik maken van traditionele wijnaanduidingen (waaronder met Port samenhangende benamingen), hetgeen neerkomt op een schending van intellectuele eigendomsrechten.

Both regions need to offer - within their respective laws, regulations and policies - adequate and effective protection of intellectual and industrial property rights in accordance with the highest international standards and agreements, including effective means of enforcing such rights.
Beide regio's moeten - binnen hun eigen wetgevings-, regelgevings- en beleidskader - zorgen voor goede en doeltreffende bescherming van intellectuele en industriële eigendomsrechten volgens de hoogste internationale normen en afspraken, inclusief doeltreffende manieren om dergelijke rechten te handhaven.
