Representatives of the United States and of the European Union and its Member States confirmed that the Protocol to Amend the Air Transport Agreement between the United States of America and the European Community and its Member States, initialled in Brussels on 25 March 2010, is to be authenticated in other languages, as provided either by Exchange of Letters, before signature of the Protocol, or by decision of the Joint Committee, after signature of the Protocol.
De vertegenwoordigers van de Verenigde Staten en de Europese Unie en haar lidstaten hebben bevestigd dat het Protocol tot wijziging van de luchtvervoersovereenkomst tussen de Verenigde Staten van Amerika en de Europese Gemeenschap en haar lidstaten, dat op 25 maart 2010 te Brussel is geparafeerd, authentiek moet worden verklaard in andere talen, ofwel vóór de ondertekening van het Protocol door een uitwisseling van brieven, ofwel na de ondertekening van het Protocol door een besluit van het Gemengd Comité.

In paragraphs 3, 4, 6, 8, 10, 11, 13 and 14, the date ‘28 September 2003’ shall be replaced by ‘the date of entry into force of the Decision of the Community/Switzerland Air Transport Committee which incorporates Regulation (EC) No 216/2008 into the Annex to the Regulation’.

In accordance with Article 18(5) of the Air Transport Agreement, as amended by the Protocol, the Joint Committee established thereunder has developed a proposal for the accession of Iceland and the Kingdom of Norway to the Air Transport Agreement, as amended by the Protocol.

RECOGNISING that it is furthermore necessary to lay down procedural arrangements for the participation of Iceland and Norway in the Joint Committee set up under Article 18 of the Air Transport Agreement as amended by the Protocol and in the arbitration procedures provided for in Article 19 of the Air Transport Agreement as amended by the Protocol.

1. The following shall be inserted after the end of point 5 (Aviation Security) of the Annex to the Agreement, as inserted by Article 1(1) of Decision No 1/2005 of the Community/Switzerland Air Transport Committee of 12 July 2005 (1):

1. The following shall be added to point 5 (Aviation Security) of the Annex to the Agreement, after the reference to Commission Regulation (EC) No 1138/2004 as inserted by Article 1 paragraph 5 of Decision No 1/2005 of the Community/Switzerland Air Transport Committee of 12 July 2005 (1):

Article 8(5) of the Regulation provides that “the coordinator shall also take into account additional rules and guidelines established by the air transport industry world-wide or Community-wide as well as local guidelines proposed by the coordination committee and approved by the Member State or any other competent body responsible for the airport in question, provided that such rules and guidelines do not affect the independent status of the coordinator, comply with Community law and aim at improving the efficient use of airport capacity.
In artikel 8, lid 5, van de verordening is bepaald dat de coördinator tevens rekening houdt met de wereldwijd of in de gehele Gemeenschap door de luchtvaartsector opgestelde aanvullende regels en richtsnoeren en met de door het coördinatiecomité voorgestelde lokale richtsnoeren die door de voor de luchthaven in kwestie verantwoordelijke lidstaat of een andere bevoegde instantie zijn goedgekeurd, mits deze regels en richtsnoeren geen afbreuk doen aan de onafhankelijkheid van de coördinator, stroken met het Gemeenschapsrecht en tot doel hebben de luchthavencapaciteit efficiënter te benutten.

5. 5. De coördinator houdt tevens rekening met de wereldwijd of in de gehele Gemeenschap door de luchtvaartsector opgestelde aanvullende regels en richtsnoeren en met de door het coördinatiecomité voorgestelde lokale richtsnoeren die door de voor de luchthaven in kwestie verantwoordelijke lidstaat of een andere bevoegde instantie zijn goedgekeurd, mits deze regels en richtsnoeren geen afbreuk doen aan de onafhankelijkheid van de coördinator, stroken met het gemeenschapsrecht en tot doel hebben de luchthavencapaciteit efficiënter te benutten.
