1. Welcomes the fact that the audit brought to light no significant weaknesses in the areas covered for the European Data Protection Supervisor;

The Agency shall carry out its tasks in the area of information society and, in particular, of the respect for private life and the protection of personal data, without prejudice to the responsibilities of the European Data Protection Supervisor to ensure that the fundamental rights and freedoms of natural persons, and in particular their right to privacy, are respected by Union institutions and bodies in accordance with its duties and powers as provided for in Articles 46 and 47 of Regulation (EC) No 45/2001.

For these reasons, the European Data Protection Supervisor (EDPS) has paid particular attention to this subject (5) and intends through this opinion to emphasise once more the need for protection of fundamental rights as a cornerstone of the Area of Freedom, Security and Justice (AFSJ) as laid out in the Stockholm programme.

Recalls that an integrated European financial market is essential to ensuring the smooth functioning of the EMU; dwells, therefore, on the need to complete financial market integration and to remove the remaining obstacles to financial integration in order to create an efficient financial system and improve the euro area's capability to deal with economic shocks; draws attention to the fact that financial integration may also pose a risk to financial stability if the procedures for crisis prevention, management and resolution remain segmented at national level , making area-wide responses more difficult; reasserts, therefore, in this context the need for an integrated European system of cooperating supervisors as one key element as regards the completion of financial market integration;
15. merkt op dat een geïntegreerde Europese financiële markt van wezenlijk belang is om te zorgen voor de goede werking van de EMU; benadrukt daarom dat het nodig is de integratie van de financiële markt te vervolledigen en de overblijvende obstakels op weg naar financiële integratie uit de weg te ruimen om een doeltreffend financieel stelsel te scheppen en de mogelijkheid van de eurozone om om te gaan met economische crises te verbeteren; vestigt de aandacht op het feit dat financiële integratie ook een risico kan betekenen voor de financiële stabiliteit indien de procedures voor de preventie, het beheer en de oplossing van crises op nationaal niveau gesegmenteerd blijven, waardoor maatregelen op het niveau van de eurozone worden bemoeilijkt; wijst in deze context bijgevolg met nadruk op de behoefte aan een geïntegreerd Europees systeem van samenwerkende toezichthouders als een belangrijk element om te komen tot de volledige integratie van de financiële markt;

Agrees with the Commission on the necessity of removing barriers for the creation of a Single European Payment Area and of taking further action to open up the fragmented retail financial services markets (savings plans, mortgages, insurance and pensions) while ensuring the protection of consumers; underlines the importance of developing a pan-European approach to financial market regulation and supervision and recalls that it is necessary to review the rules on insurance solvency (Solvency II) as well of those concerning the discretionary powers of regulators in the case of cross-border mergers to avoid conflicts between the supervisors in the home and host Member States;
