Onverminderd lid 4 staat het de overeenkomstig de twee streepjes van de eerste alinea bevoegde Lid-Staat vrij voor de uitvoer van cultuurgoederen vermeld in het eerste en het tweede streepje van categorie A 1 van de bijlage geen uitvoervergunning op te leggen, wanneer deze goederen van beperkt archeologisch of wetenschappelijk belang zijn en mits zij niet rechtstreeks afkomstig zijn van opgravingen, vondsten en archeologische locaties in een Lid-Staat, en zij zich legaal op de markt bevinden.
