4. In fulfilling his/her responsibilities under paragraphs 2 and 3, the Secretary-General shall be assisted by the Deputy Secretary-General, the Directorate for Security and Risk Assessment, the Directorate for Information Technologies (DIT) and the Classified Information Unit (CIU).

2. The Director shall be assisted by three Deputy Directors appointed for a four-year period extendable once in accordance with the procedure laid down in paragraph 1.

2. Should the Director or one or more of the Deputy Directors be unwilling or unable to act in accordance with paragraph 1, the Management Board shall appoint an interim Director or interim Deputy Director(s) as required for a maximum period of 18 months, pending the appointments provided for in Article 38(1) and (2).

Should the Council decide not to remove the Director or Deputy Director concerned from his post in accordance with Article 9(1)(h) of Annex IX to the Staff Regulations or otherwise terminate his service at Europol, the matter shall be referred back to the Management Board in the case of the Director or to the Management Board and to the Director in the case of a Deputy Director.
5. Indien de Raad besluit de betrokken directeur of adjunct-directeur niet uit zijn functie te ontzetten overeenkomstig artikel 9, lid 1, onder h), van bijlage IX bij het Statuut noch zijn dienst bij Europol anderszins te beëindigen, wordt de zaak terugverwezen naar de raad van bestuur in geval van een directeur en naar de raad van bestuur en de directeur in geval van een adjunct-directeur.

4. Upon receipt of an opinion of the Management Board, as referred to in paragraphs 2 or 3 of this Article, the Council shall, after having heard the Director or Deputy Director concerned, decide whether to remove the Director or a Deputy Director from his post in accordance with Article 9(1)(h) of Annex IX to the Staff Regulations or otherwise terminate his service at Europol.
4. After the disciplinary procedure provided for in Annex IX to the Staff Regulations has been followed, the service of the Director or of a Deputy Director may be terminated by the Council without notice on disciplinary grounds, in accordance with Article 49 of the Conditions of employment, in serious cases of intentional or negligent failure of the Director or a Deputy Director to comply with his obligations.

For the post of a Deputy Director, the Committee shall be composed of the Director, or a Deputy Director delegated by him, of the member of the Management Board representing the Commission and of five Management Board members representing the Member States who shall be determined by the drawing of lots by the Management Board.
